PATIALA: Indian Ex-Services League, Punjab & Chandigarh has sought a better deal for Havildars and Sub Majors from the Centre Govt. Prabhjot Singh Chhatwal, president of league in his memorandum faxed to Defence Minister, A.K. Antony, has asked the govt. to change the Pay-Band for Havildars and equivalent ranks from PB-I to PB-II and for Sub. Majors and equivalent ranks from PB-II to PB-III since the Sixth Pay Commission have not done justice with these ranks.

League stressed upon the govt. that the soldiers of the rank of Havildar form the real back-bone of Defence Forces and Sub. Major acts as a Chief executor of the strategy in the war. These two ranks have been virtually crushed by the partial recommendations of Sixth Central Pay Commission and further faulty implementation of the recommendations regarding their pay scales. The Havildars have been virtually equated to class-IV civilian such as Peons, Chowkidars, Mali and Dhobi etc. in respect of pay.

League has further asked the Minister to release immediately the orders for promised ONE RANK ONE PENSION for Junior Commissioned Officers, Senior Non-Commissioned Officers, Non-Commissioned Officers and other ranks which was announced by Finance Minister in Union Budget on 6 July 2009, and then by the Minister him self in the Parliament and finally by Prime Minister on Independence Day but the order regarding the same has not not been issued so far.

League has also reminded the Minister that the govt. has also promised to give pension to soldiers up to the rank of Hav. @ 70% and to JCOs @ 60% of the last pay drawn to compensate for their early compulsory retirement, but to the great disappointment of the soldiers, these orders have also not seen the light so far whereas orders regarding change of Pay Band from PB-III to PB-IV for the Lt. Col. have been issued long ago although these recommendations were made by the same group of ministers in the same report. With this partial treatment given to lower ranks, a great resentment is prevailing in the Defence Forces and among the veterans which is not good for nation’s security.

League has further demanded two pensions for the widows of ex-servicemen who drew two pensions during their life time. Because of early compulsory retirement, most of the soldiers have to seek employment in civil depts. to compensate their meager pension which they draw by virtue of their service in the Defence Forces. Such veterans draw two pensions after their retirement from civil depts. but their widows are not entitled for second pension as per the present pension policy of the govt.

Along with this, League has gone further to demand befitting alternate re-employment for the soldiers up to the age of 60 years like their civilian counter parts since about 90% among the soldiers are compulsory retired prior to their superannuation to keep the forces young.

League has vehemently stressed upon the govt. to fulfill the demands of veterans at the earliest lest they may come on the roads like civilian counter parts and the govt. will be in a critical position to handle that volcanic situation.

Last but not the least, the league has forcefully demanded of the govt. not to use the term PBORs for Junior Commissioned Officers, Senior Non-Commissioned Officers, Non-Commissioned Officers and other ranks as they feel much humiliated by being referred as such.

As reported in this Blog earlier on 20th September, 2009, (Late) Smt.Muthammal left behind one daughter and one son. She had two daughters and one son. The elder daughter died leaving behind two children (the grand children to Smt.Muthammal) and the son-in-law of her elder daughter still remaining as a widower with two children.

There is lot of misunderstanding among the children of Smt.Muthammal (the legal heirs) to come to the Bank for claiming the L.T.A amounting to Rs.4 lacs.

Any amount of conciliation meeting with the legal heirs of (Late) Smt.Muthammal did not work out. The unreasonable enmity among the family members went to extent of dropping the LTA claim from the Bank.

It was with the untiring efforts of one our Exwel Trust’s well wisher, and a Social Reformer Flt.Lt.C.Chandrasekar, MA (Sociology), & M.A. (Economics), a retired Air Signaler of the IAF with the help of one retired Police Inspector brought all the legal heirs to the Trust’s Office and persuaded them to claim the LTA united and later take the benefit equally. It was a great task to Flt.Lt.C.Chandrasekar to search the whereabouts of the legal heirs, who were living in remote villages of the Tirunelveli District, where there is no motor able roads to these villages.

During the last days of her life Smt.Muthammal lived with her younger daughter. As she did not know her correct pension entitlement, she used to draw only Rs.3000 every month thinking that is her pension and leaving the remaining money in her pension account for a number of years without knowing the accumulation in her SB account. Whenever she needed some extra money, the Bankers used to sanction Pension Loan even though there was sufficient money available in her SB account. If the Bankers would have guided her properly, she would not have asked for any loan. The attitude of the Bankers towards these illiterate customers made the status of the pensioners miserable.

Now it is very difficult to get a Legal heir ship certificate from the Revenue authorities. The revenue department’s procedure is made so complicated, even a learned man has to bribe for getting a death and legal heir certificate.

My dear Bankers, please help the illiterate pensioners to enjoy their full pension by paying their correct pension in the last days of their life.

(Late) Subedar Ram Chand (a World War II Veteran) (1900 – 1970) of Village Bohan, of Hoshiarpur District in Punjab is being remembered today by the Exwel Trust.

Visibly moved by the activities of the Exwel Trust, his son, a retired Wing Commander Sushil Sudan (A decorated Electronic Engineer of the IAF) (Age.72 + now settled in Canada) makes generous contribution of Rs.10,000/- in memory of his late father.

The Managing Trustee, Sgt.R.Chellappa (Retd.) and all the Trustees of Exwel trust conveys their sincere thanks for this noble gesture. THE STATE OF SPL. FAMILY PENSIONER & HER FAMILY

THE STATE OF SPECIAL FAMILY PENSIONER AND HER FAMILY.

Special Family Pension is sanctioned to a widow only when the death of a soldier is aggravated by military service as determined by the competent authorities and therefore a higher rate of pension is sanctioned to the widow. Normally this PPO is identified by a Prefix ‘F’, or ‘BC’ before the PPO number. The PDAs are not aware of this basic rule as a result, the higher rate of pension payable to the widow is denied for ever.

Sep.No.8799083 Maruthiah Thevar died while on active service on 19.10.1971. His wife Smt.Muthammal was sanctioned Special Family Pension w.e.f. 20.10.1971 under PPO No.F/5280/1974.

She was drawing her family pension from Canara Bank, Veera Keralampudur Branch of Tirunelveli District, Tamil Nadu. There have been 4 pay commissions after 1971. The pension has undergone revision in three pay commissions. There is distinct difference in Ordinary family pension and Spl. Family pension. The 5th and the 6th CPCs doubled the minimum ordinary family pension for the Special Family pensioners.

Now the question is, did this improvement in pension on the successive pay commission reach the family pensioners ? A big NO is the answer. Here is a case.

Smt.Muthammal, a special family pensioner was eligible for a monthly basic pension of Rs.2550 from 1.1.96 to 31.12.2005 but was paid only Rs.1275 during that period. Similarly from 1.1.2006 she was eligible for Rs.7000 as per 6th CPC, but was paid Rs.3500 only. The actual position from 1971 to 1995 is not traceable.

In the meantime she died on 15.5.2009. When the Exwel Trust’s Chief Liaison Officer, Sgt.S.Kandiah (Retd.) visited the Bank for arranging the payment of the Life Time Arrears to her legal heirs, he was surprised to see that the widow has been paid just minimum ordinary family pension from 1971 till date. The status of her special family pension was not at all effected in her monthly pension for the 33 years. None of the Bank’s auditors, Accountant General’s Auditors, the Reserve Bank’s pension auditors did notice this short payment to this widow for the past 33 years. See what a pity ?

The poor widow could not enjoy her legitimate pension for the past 33 years. Now the LTA amounting to Rs.4 lacs has to be claimed with lot of legal formalities.

There is another similar case with Canara Bank, Tenkasi of Tirunelveli District. Ex.Gnr.No.128413 Krishnan died while in service on 06.2.1979. His mother Smt.Subbulakshmi was sanctioned a Special family pension under PPO No.F/2237/80 w.e.f. 7.2.79. This poor mother of a soldier is also being paid simply ordinary family pension instead of Special family pension from 1979.

Fortunately, in this case, she is alive now. Her another son Ex.Hav.S.Sankaran came to know about the Exwel Trust’s services to the pensioner. He visited the Trust’s office with her mother’s pension papers.

The short payment of about Rs.3,84,000 has been worked out and presented to the bank for immediate payment to Smt.Subbulakshmi.

Now the question is What is the solution for this problem ? There are many cases of short payment in defence pensions with almost all the pension paying banks. The MOD and the CDA(P) are keeping silent about this. The ex-servicemen welfare organizations like IESL, IESM, AFA and the Naval Foundation should come out with a strong protest and formulate a system for payment of correct pension to all the defence pensioners.

In this age of information technology revolution in the Banks, incorrect payment of pension to the pensioners cannot be accepted. It is a shame on the part of the Banks to pay incorrect pension to poor widows. Will the Banks do something to correct the position ?

EXWEL TRUST DOES WONDERS AT TIRUNELVELI


The Ex-servicemen and Social Welfare Trust at Tirunelveli, which is concentrating on payment of correct pension to the Defence pensioners is doing a great service to aged pensioners. Here is one case which the Trust members have found out recently and enabled one 91 years old Widow to get an arrears of Rs.1,50,792/-. At last and not the least, but for the timely intervention of the Exwel Trust Tirunelveli, a huge amount would have gone away unnoticed and unclaimed.


Smt.Grace Rajam Rhenius, W/O (Late) Major F.S.Rhenius,( No.IC 11337) aged 91, was traced out by the Trust members to find out whether she is being paid the correct revised pension by the Bank or not.

The Managing Trustee Sgt.R.Chellappa, (Retd.) and Flt.Lt.M.P.Natarajan, (Retd.) the Chief Admin. Officer of the Trust and Sgt.S.Kandiah, (Retd.), the Chief Liaison Officer, took all the pain to locate the house where she was found bedridden due old age. When the Trust members recalled her husbands heroic deeds of those days, Smt.Grace Rajam woke up from the bed immediately with great joy and embraced all the Trust members.

Our main concern was to get her correct family pension at this old age from the Bank. We found that the bank had off course revised her basic pension correctly, but had not paid the Additional Pension for the age of 91 which is 40% more than her present pension.


The Exwel Trust’s Chief Liaison officer Sgt.S.Kandiah (Retd.) gathered all the particulars and contacted the Canara Bank, Tirunelveli Town Branch to pay the arrears of Rs.1,50,792 immediately. The Bank also obliged the request and agreed to pay within a week.


Smt.Grace Rajam and her daughter Dr.Nirmala, were surprised over the visit of the Trust members to their house and were immensely happy to pose for a photograph with the Trust members.

MAJ.GEN.R.N.RADHAKRISHNAN (RETD.) MEETS RRM.

Here is What Maj.Gen. R.N.Radhakrishnan (Retd.) would like to share with the veterans after meeting the RRM.


Dear Veterans


I had an opportunity to meet the RRM on 16th at 1500 H; thanks to Brig RKS Gulia, the President IESL. Brig Gulia apprised the Minister of the IESL and the various problems that haunt the ESM community.

One point, he made that I would take the liberty to convey to you all, is for initiating periodic meetings with ESM community not only at the Center level but also at the State levels. IESL also presented a brief on the Cabinet Secretary’s (CS for short) Report of 30th June 2009.

In my turn, as I was given the opportunity to talk about our demand on pension, I focused on the two misperceptions on the part of the CS.


· First; his concentrated effort to drive home the fact that OROP was not approved by the Courts and the Ministers in the past, was based purely on the wrong perception of the interpretation of OROP. He had relied on the Ministry of Law and Justice’s comment describing OROP as one rank one pension with no regard to the difference in the service rendered thereby the difference in the average emoluments that count for the pension. I categorically pointed out to the RRM that presenting that argument is purely to divert the attention on the correct definition of our demand for pension as ‘same pension for same rank with same years of qualifying service’.


· Second; The CS has repeatedly equated the Armed Forces personnel with Civilian Government employees, in his report. I had highlighted to the RRM the various points to prove that there can never be any comparison leave alone equation. For details you may read my earlier mail on the ‘Analysis of CS’s Report’.


· However, I focused on the arbitrary gradation of the pension of the various ranks and the drastic difference in the pension of the senior of pre 2006 vintage to that of post 2006 vintage.


The point I am trying to make to you is not for any appreciation from you, but for your reconsideration of our efforts to get our dues from the Government.


· It is not what we want but what is projected to the Ministers on file that impresses the Minister and they take decisions on the basis of the information projected on the file. As we know that misinformation has been projected on the files over the decades, it is our bounden duty to replace the misinformation with the correct facts.


· We have to produce facts and figures to justify our demand. Can we expect that the bureaucrats shall do it for us? Or, do we expect that the Ministers should do it for us, getting convinced of authenticity of our demand, just because that we make emotional demand?


My submission is that we should form a task force to work out the implications of the implementation of our demand both financial and administrative in nature and present it to the Minister to convince him of the feasibility, and preferably in one voice. In my opinion, it is only method by which we can get our dream of OROP in its true meaning realized.

2nd FAMILY PENSION TO THE WIDOWS

2nd FAMILY PENSION TO THE WIDOWS OF THE RE-EMPLOYED EX-SERVICEMEN.


Government of India, Ministry of Personnel, Public Grievances and Pensions, Department of Pension and Pensioner’s Welfare through its Office Memorandum No. 1/19/96-P&PW(E) dt.19/7/2002 allowed family pension under the EPF Scheme 1995 and the FPS 1971 in addition to the Family Pension under Rule 54 of the CCS (Pension) Rules 1972.


This benefit is available from 27.7.2001. It means that all the widows of the re-employed ex-servicemen, whose husbands were drawing two separate pensions and died before 27.7.2001 and after 27.7.2001 are now eligible for two family pensions. But practically this benefit has not been availed by any widow till date. The reasons are:-


1. The O.M. No.1/19/96-PPW(E) dt.19.7.2002 by the Dept. of Pension and Pensioner’s welfare has not been widely circulated. The MOD, Dept. of Ex-servicemen Welfare had not circulated this order.


2. The Record Offices and the respective departments where the ex-servicemen were re-employed had joined together and ensured that only one family pension is released to the widow.


3. Since most of the ex-servicemen re-employed prior to 1986 had not done the endorsement of family pension, their widows suffered a lot to get one pension even though their husbands were drawing two pensions.


4. The Record offices refused to endorsement of family pension without getting an no-objection certificate from the re-employer that they will not sanction any family pension.


5. In some cases, the re-employers such as the Nationalized Banks, PSUs like the Indian Oil Corporation, Bharat Petroleum Corporation, etc., who are having EPF scheme 1995 released the family pension to the widow immediately. After accepting this EPF scheme 1995 pension, when the widow applied for the defence family pension, the record offices simply turn down the application stating that they are eligible for only one family pension. Thus the widow continued to lose her legitimate defence family pension even after issue of the order from 27.7.2001.


Thus the widows of the re-employed ex-servicemen whose husbands were drawing two pensions before 27.7.2001 or after 27.7.2001 and died subsequently are though eligible for two family pensions, but are being paid only one pension.


The MOD, Dept. of Ex-servicemen Welfare should issue a circular on the subject immediately and enable the widows to get both the family pensions in the last days of their life. Otherwise the name given to the Department “Dept. of Ex-servicemen Welfare” will become meaningless.


As of now all the widows of ex-servicemen, whose husbands were drawing two pensions are eligible for two family pensions w.e.f. 27.7.2001 depending upon the date of death. Those who have died prior to 27.7.2001, the family pension will be paid from 27.7.2001. Those who have died after 27.7.2001, the family pension will be paid from the next of day of death.


In these present state of confusion with the Pension Disbursing Agencies, even the living pensioners are struggling to get their correct pension, then who will help these widows to get their 2nd family pension.


The ex-servicemen welfare organizations like IESL, IESM, AFA, Naval Foundation etc., should take up the matter seriously with the government and render justice to these widows.

A beautiful analysis of the Cabinet Secretary's report on OROP dt. 30.06.09 by Maj.Gen.R.N.Radhakrishnan has been published.

A subject for every veteran to read and understand. A clear foundation for our demand. A well written justification for our demands.

The Government should consider our demands at least now. Better late than never.

Kudos to Maj.Gen.R.N.Radhakrishnan, (Retd.) (Vice President, Indian Ex-services League and President, Tamilnadu Ex-services League.) for presenting this wonderful paper to the Government on behalf of the two million ex-servicemen.

Today is a historic day in the history of Indian Military Veterans of all arms. We all have completed one year of our peaceful struggle for OROP. The GOI has been compelled and forced to consider our justified and legitimate demand for ONE RANK ONE PENSION. In my view we have all gathered here to contemplate on our past actions and discuss and explore our future plans of action. In my brief talk, I will try to cover the following points:


1.Achievements of IESM in the past one year

2. Actions taken by the government, the politicians and the bureaucrats

3. Possible reasons behind OROP not being granted as yet

4. Possible course of action for the future

5. And finally and most importantly, how each and every ESM can contribute to this mission.


1.Achievements of IESM in the past one year:


(a)This is the first time that the issue of OROP has been mentioned in the Presidential Speech in the Parliament. This has been possible only because of the massive action taken by IESM.


(b)A large number of senior officers and all Ranks of all arm have come together under the IESM umbrella. This involvement has been totally selfless from all members and it is an astonishing feat achieved by the Indian Military Veterans community.


(c)A dedicated, able and effective leadership has taken charge of this mission and will most definitely steer the mission to victory and success.


(d)The government is now fully aware of the fact that the planning and execution of IESM is way beyond their control and that IESM is growing faster than they could ever imagine. That is why the government is reluctant to talk and negotiate with the IESM.


2.Actions taken by the government, the politicians and the bureaucrats:


(a) Divide and Rule - Instead of solving the problems of ESM and carefully considering the legitimate demand of OROP by the military veterans, the government has been trying to divide us in segments like ranks, arms, Officers, JCOs, ORs. They have been trying to segment and divide our power and strength.


(b) Using small ESM organizations with vested interests, the government has been trying to advertise that they care for the welfare of the veteran community, all of which is a false propaganda.


(c) The GOI should recognize and be grateful to the officer community especially the chairman IESM, for it is because of them this mission is still peaceful.


(d) The PBOR community is so full of anguish that if left uncontrolled/unguided they will not refrain from resorting to other means of making the deaf hear our voice. That said, I must underline the fact that this is a rather dangerous game the GOI is playing and it better be aware of the consequences of this.


3.Possible reasons behind OROP not being granted as yet:


(a) I feel that reason behind the fact that OROP has not been implanted in its true nature and spirit is the fact that each and every action/decision/step taken by the IESM leadership is being debated.


(b) This is a clear sign for the GoI that the ESM community is not united. The proverb “Too many cooks spoil the broth” is so truly applicable to this situation. We must all understand that this too is like a war for justice and no war can ever be won if there are more than one orders given at the same time or if, on every decision, a committee or a consensus must be formed.....


(c) With respect, I want to bring forth a very important and serious issue regarding the devaluation of JCOs, NCOs and equivalent ranks of all arms. The JCOs are commissioned by the President of India and it is a class II Gazetted Rank. Now it has been replaced by a term “PBOR”. Where did this term “PBOR” come from? I find it amusing and rather disturbing that it has been so easily accepted by our service chiefs and the boards of JCOs and NCOs have been replaced by PBOR!


Rank degradation was a major issue taken up by most ESM organizations. Similarly the same issue of rank degradation holds good in coining this term “PBOR” and must be dealt with utmost seriousness. On the Blog REPORTMYSIGNAL it is seen that each rank is interested about its own interest. This is a point I have personally raised with the Vice Chairman in the past as well. It has also been raised earlier by Sgt. Prabhjot Singh PlS (Retd.), President, Indian Ex-Services League, Punjab and Chandigarh .



This is the root cause of defamation of the Army. It starts from the soldiers and creeps all the way up to the levels of senior officers as well. The time has now come for all ranks to forget about their individual benefits and unite for Social Justice and Respect of the Indian Military Services. Many senior officers have rightly pointed out that we should learn from neighbors and the past history. Service years were different and the times now are different. Why is any body/organization not thinking for the benefit of all ranks all arms (from Sep to Gen, including Ex Service Men)? Has GOI been successful in its divided and rule policy inherited from the British?


4.Possible course of action for the future:


Therefore my request with the entire ESM community is this:


(a) Organizations founded for the welfare of ESM have failed the very purpose of their existence. IESM, in my humble opinion, must make an effort, to get rid of the people filling holding these appointments (and making a mess of the entire organization) and to replace these people with those who are really devoted to the cause of the ESM, who can understand and appreciate the reason why these bodies were founded.


b) Many states like Punjab have been exemplary in this regard where these organizations still perform the duties they are supposed to. (c) Let us all be united in our thoughts, actions and words. That is the only way we can become a force strong enough to shake the high offices in New Delhi.


(d) Let us all have faith in the IESM leadership. The chairman and the steering committee is what the Captain is to a boat or a Pilot to an airplane.


(e) Let us not criticize others. Instead, do the best we can in our own capacities to help the mission become successful. (f)Once a decision has been taken, let us all own it – for better or for worse – understanding that the intent behind taking that decision was the success of the entire mission. (g) Please do not criticize our leaders, do not comment on there integrity and leadership capabilities. They have brought us here and they will, most definitely,make this mission successful. (h) Lastly I whole heartedly support the suggestions of Vice Chairman Maj Gen Satbir Singh and Col Rajan for the future plan of action.


5.How Can One Individual ESM Help:
One must both generously and seriously think about how he/she can help the Mission OROP. Some can help with money (donations), some with their organizations, some with organizing local meetings and seminars, some can give time and man power, and some can help with material/items. Where ever an ESM goes, let it be ECHS, CSD offices and any where, we can talk about this movement get membership form and deposit medals.
