DENIAL OF DUAL FAMILY PENSION IS A GREAT INJUSTICE

A large number of representations are being sent to concerned authorities.  The matter was referred to 6^th CPC also.  So far no reply from the Government (MOD).  The 6^th CPC also did not take up this matter.  The widows of the re-employed ex-servicemen are the worst affected on this issue.

Recently the Air Force Association Thanjavur Sub Branch took up this issue on behalf of the widows of the Air Veterans through Air Force Wives Welfare Association.  The reply received is given below for the information of all concerned.

DUAL FAMILY PENSION

1.            Please refer your lettr dated 11 May 12 addressed to President AFWWA (Central)

2.            It is brought to your kind notice that as per para 195 (a) of Pension Regulations for the Air Force 1961 (Part 1) applicant will not be eligible for family pension if he or she is in receipt of another pension from the Govt.  In addition as per GOI MoD letter No.2/CC/B/D/(Pen/Ser) dated 28 Aug 01 read in conjunction with DP & PW’s Office Notification No.1/19/96/P&PW(E) dated 27 Jul 01, dual family pension from defence side in addition to the family pension from the re-employer is allowed only to those family pensioners, who are invariably drawing family pension under Family Pension Scheme 1971 or Employees Pension Scheme 1995 through Regional Provident Fund Commissioner.

3.            It is also pertinent to mention here that Family Pension Scheme 1971 or Employees Pension Scheme 1995 is in force in those factories/establishments, which are covered by the Employees Provident Fund and Miscellaneous Provisions Act 1952 (EPF & MP Act 1952).  Public Sector Bank/Insurance Companies and their employees are outside the purview of this act and they have their own pension schemes and which are always prefixed by the name of the Bank/Insurance company such as Canara Bank Employees Pension Scheme 1995, LIC Employees Pension Scheme 1995 or General Insurance Employees Pension Scheme 1995 etc.  Therefore dual family pension from defence side in addition to the family pension from the re-employer is not eligible except those who are drawing family pension under the schemes mentioned at para 2 above.

4.            The various judgments quoted by you are applicable for that particular case only and cannot be set as precedent in the absence of specific Govt order on the subject.

5.            Notwithstanding the above, this office has already taken up the case with Air HQs for grant of dual family pension to the widows of AF personnel and the same is under consideration at appropriate level.
