6^th PAY COMMISSION ANAMOLIES AND ITS IMPACT

ON AGED PENSIONERS AND FAMILY PENSIONERS

The anomalies arising out of the 6^th CPC Recommendations were settled through various legal procedures and Cabinet Committee Resolutions. It took 6 to 10 years to settle. By the time

many aged pensioners died, and  their legal heirs never claimed LTA and allowed its natural death.

Even the delinking of 33 years for full pension judgment orders still kept pending for defence pensioners.  The Pension fixation formulae “Pay in the pay Band” and “Min. of the pay in the Pay band” dispute took 7 years to get the verdict in favor of several lakhs of pensioners.

The benefits of these judgments are not passed on to the pensioners in time.  The Defence Pensioners are the worst effected lots in this area.  Most of the benefits are ranging from 1.1.2006 to 23.9.2012 (81 months) involving considerable amount of arrears to the aged pensioners.  Even though the CDA (P) issued circulars to the banks to pay arrears, but none of the Banks pay correctly to all pensioners.  The aged family pensioners are most affected.

The correct rate of enhanced pension payable to a family pensioner, whose husbands died during the period from Sep 2002 to Sep 2012 were denied due to the anomaly in the 6^th CPC.

The enhanced pension payable for a limited period such as 7 years period is also over. 

Now the Government had issued orders to pay the correct rate of enhanced pension to the widows.  Unless the widow is vigilant in claiming the arrears, she will not get at all.

Similarly, there are so many back dated arrears authorized for different types of pensions such as

Special Family Pension, Disability pension, Liberalized family pension, War Injury pension, etc. etc. including Enhanced Family pension which was denied during the period from 1.1.2006 to 23.9.2012.  We are giving an example of Arrears calculation for A Group X Sgt.
