PENSION MELAS



PENSION  MELAS

Refer our Blog posts dt.13.07.2011. on the Pension Melas conducted by the Ex-servicemen Helpline Centre, ATNK&K Area HQ, Chennai 9.  The programme was very useful to poor pensioners and family pensioners.

Now it has come to our notice that the Pension Melas programme published earlier has been cancelled by the GOC, ATK&K Area HQ.  No reason has been given for cancelling such a good welfare programme.

The initiative taken by the Officer i/c ESM Helpline Centre, Chennai during the first pension mala in Tirunelveli region was very much appreciated by all the pensioners.

It requested that the GOC, ATNK&K Area should reconsider the issue and arrange for conducting these pension melas programme throughout Tamil Nadu.

LOSS OF PPOs/ISSUE OF DUPLICATE PPOs.

To avoid delay in payment of pension, where a PPO issued by Pension Sanctioning Authority is lost a certified true copy thereof will be obtained urgently from the Pension Sanctioning Authority by furnishing a loss certificate to be sent under registered cover to the authority who initially sanctioned pension i.e. Pr. CDA(P), Allahabad/CDA(N) Mumbai/DCDA(AF) New Delhi.

If a PPO issued by the Pension Sanctioning Authority is lost in PDAs office, a certified true copy thereof can be obtained from PSAs on furnishing a certificate on the following lines:

“Certified that P.P.O. No…………..in respect of Personal No./Regimental No. (Rank and name of the Unit/Formation)…………………………has been lost/is not available and to avoid double payment being made a note has been kept in payment/Check Register on record in my office.  The same if found or received from any authority at a later stage will not be acted upon but will be returned to concerned Pension Sanctioning Authority for cancellation”.

PENSION FOR RESERVISTS 
Dear Sir,

I had reported earlier that 11 airman of IAF had gone to SC for the grant of Reservists pension to them. Air HQ had accorded necessary sanction for issue of PPO to PCDA, Allahabad under the powers vested under GOI ,MOD letter no4684/DIR(PEN)/2001 dated 14 August 2001 read with letter dated 7 November 2001.These powers have been delegated to all three Service HQ for various administratative sanctions.

I have received a copy today sent by AFRO vide letter No RO/2801/211576/05/63/P&WW(SP) dated 17 Aug 2011 addressed to the bank of each individual attaching original PPO in each case.Most of them have reached the age of close to eighty years by now. It is a classic case of perseverence and patience.This case has come to a logical conclusion after 3 years of struggle.The period covered in this case is from 1962 to 1972 when these veterans were called up for active service for short periods during three wars that we engaged in.

I am now asking AFRO,CABS(IN) and all CROs(46 of them) of Indian Army if they have similarly placed ESMs  and the number involved.We must take it up with SC directly once this info is compiled in respect of all those left out veterans and may be their surviving widows to sanction pension.The added benefit is that they can now become members of ECHS and get medical cover.

How will Lokpal provide relief to a common man against bribery?


Today, a common man has to pay bribe to get any work done in any government department like making ration card or passport or getting income tax refund or old age pension etc. Jan Lokpal and Jan Lokayukta will provide relief to a common man against such day to day corruption. 

Ø  Each government department will have to make a Citizen’s Charter telling who does what job and in how much time. For instance, the charter will have to mention which officer will make ration card and in what time, which officer will make a passport and in how much time etc.

Ø  If Charter is not followed, then people can complain to the Head of that department who will be designated as the Public Grievance Officer (PGO)

Ø  PGO will redress the complaint within 30 days maximum

Ø  If PGO doesn’t satisfy the complainant, then a complaint can be made to the vigilance officer of Jan Lokpal and Jan Lokayukta. Lokpal  will have a vigilance officer in each district and Lokayukta will have it in each block.

Ø  When a complaint of violation of citizens charter reaches a Vigilance Officer, it will be deemed to have corruption angle. 

Ø  The Vigilance Officer will have to:- 

o              Solve the grievance in 30 days
o             Impose penalty on the guilty officers which will be given to the Complainant as compensation
o              Start investigations of corruption against guilty officers. 

Ø  If a citizen is not satisfied with the action taken by Vigilance officer, he could appeal to the Chief Vigilance officer in Lokpal or Lokayukta.

Ø  The officers of any department against whom financial and departmental penalties have been imposed may appeal against it in High Court.

Ø  We believe that as soon as a few penalties get imposed upon the Head of any Department, he will put adequate systems in place and ensure that no grievances take place in future.

WAR INJURY PENSION



WAR INJURY PENSION

1.      War Injury Pension is granted to armed forces personnel, who is injured in a war or specified war like situation.
2.      The PPO of a war injury pension is identified by the prefix D/BC/Number/Year.  Where ‘D’ stands for disability and BC stands for Battle Casualty.
3.      The Service Element of war injury pension will be equal to service pension to which he would have been entitled on the basis of his pay on the date of invalidment.  Counting of service upto the date on which he would have retired in that rank in normal course, including weightage as admissible w.e.f. 01.07.2009.  This service element is paid on the minimum of the pay in the pay band plus grade pay, MSP, X GP pay where applicable independently.
4.      The War Injury element also will be equal to the revised pay structure for 100% disability as given above.  It is proportionate to the percentage of disability.

Since the ceiling on aggregate of War Injury Pension (The total of service element and War injury element) with reference to the minimum of the pay in the revised pay structure applicable from 01.01.2006 stand removed with effect from 01.07.2009 there is considerable change in the war injury pension.

Unfortunately, the CDA(P) Circular 456 does not give any pension entitlement table to show the actual pension entitlement of a war injured soldier with 100% injury.  There is no table for showing the rates of service element of war injury pension on invalidment and on discharge.  It will be very difficult for the PDAs to fix the pension without referring to the CDA(P), thus causing delay in revising the pension.

WAR INJURY PENSION ON RETENTION IN SERVICE

Armed Forces personnel who are retained in service, despite the disability due to War injury, sustained under circumstances mentioned in Category ‘E’ of Para 4.1 of above Gvt. Letter dated 31.01.2001 and retire subsequently, will have an option to be exercised within a period, as prescribed by the Govt. from time to time be:-

            To draw lump sum compensation in lieu of war injury element foregoing war injury element at the time of subsequent retirement/discharge.

                                                                        OR

            To draw war injury element at the time of retirement in addition to Service Pension admissible on retirement/discharge foregoing, lump sum compensation.  The rates of minimum War Injury Element for 100% disability in case of discharge payable w.e.f. 01.01.2006 will be 60% of the total of minimum emoluments including MSP & X Gp. Pay. with a minimum of Rs.7020.  Refer Table No.6 of CDA circular No.456.
