100% RESTORATION OF FAMILY PENSION

Whenever a Family Pension is divided due to circumstances unavoidable for various reasons, the amount of family pension gets reduced to the individual. However, when the other claimant becomes ineligible for the share, the widow’s share automatically to be restored the full pension. It has come to the notice of our Trust, that some widows divided share has not been restored even though the other claimant has become ineligible for the other share for a long period.

For example, a family pensioner is getting a basic pension of Rs.638; it means 50% of Rs.1275/- (As per the 5th CPC.) The Bankers do not revise to Rs.1750 which is 50% of Rs.3500 as per 6th CPC as they are not aware of the basic principle of sharing the Pension due to circumstances. But the banks are prompt in stop paying the pension for the ineligible member. The restoration is not done to the original pensioner (widow).

For Example: Second wife and daughter of first wife getting the divided pension. The daughter of first wife got married and becomes ineligible. The second wife should get the full pension.

Our Chief Liaison Officer S.Kandiah came across one such case with Central Bank of India, Kovilpatti, Tuticorin District., Tamilnadu. The Pension paid particulars as follows:-

Basic Pension ....... .Rs.638

Dearness Pension ....... .Rs.319

Total .... . Rs.957

DA @ 47% ...... .. Rs.450

Medical Allowance .....Rs. 50

Total Pension Rs.1457/-

The poor widow instead of getting Rs.4545 per month ( Rs.3500+945+100) is being paid Rs.1457. The bankers want a separate order for restoring the 100% pension for the widow. The CDA and Record Office are not in a position to issue the letter to the Bank.

Dear Veterans, Please help such widows to help their full pension. If there is any such case please bring it to our notice.

GOOD NEWS FOR AGED VETERANS DRAWING DISABILITY PENSION


GOOD NEWS FOR VETERANS DRAWING ADDITIONAL PENSION
(Veterans aged 80 years and above.)


As per CDA circular No.397 MOD letter dated.11.11.2008, veterans above 80 years are eligible for Additional pension according to their age.

Now CDAP Allahabad had clarified that the Disability pension can be added with the basic pension
For arriving at the amount of additional pension to be paid to aged veterans who are above 80 years.


For Example a Basic pension is : Rs.3500
20% Disability Pension : Rs. 702
Total :Rs.4202
Now Additional Pension
@ 20% (80 to 85 years) :Rs. 841
Total Basic Pension :Rs.5043
Plus DA for Rs.5043 @27% :Rs.1161
Total Pension :Rs.6204

THIS RS.6204 APPEARS TO BE A REASONABLE AMOUNT FOR AN AGED

VETERAN.

THE REVISED PENSION FOR JCOS & BELOW


THE revised pension for JCOs & below

A most valuable comment that every PBOR should read & appreciate.

The new pension rules for our veteran brothers up to the JCO & Eqvt level based on the recommendations of Secretary committee are finally out & accessible to all the interested veterans having computer access.
In this connection I would like to bring out my comments published earlier in this blog which are copied & placed below.
The revised pension per the proposal of secretary would most likely be for X group with 33 years of service including weightage:

Sepoy 50% of 14050 = 7025
Naik 50 % of 15060 =7530
Havildar 50 % of 16710 =8355
Naib Subedar 50 % of 23020 =11510
Subedar 50 % of 26210 = 13105
Sub Major 50 % of 26900 = 13450

You may verify these figures from the table in 6th pay commision report , modified by the secretaries Report.The formula for my calculation was given in my earlier comments.

I should bring out here that my calculation was slightly different for the ranks of Sepoy ,Naik & Havildar due to my omission of element of Classification pay/allowance of Rs 120/- thereby showing a discrepancy of Rs 60/- in my figures arrived at.However ,the figures in respect of Nb Subedar ,Subedar & Sub Major are correctly calculated by me as compared to the figures appearing in the table for army veterans in group X at 30 Years plus service.
Now it would be interesting to compare the pension if it was granted @70% of the minimum of the pay band as per the scale approved by the Govt.


The amount of pension based on 70% of the minimum pay band is placed below for comparison with the amount now approved by the Govt:
Sepoy : 70% of (5200+2000 grade pay+2000 MSP +1400 Group X pay +150 of Classification pay=10750x70%=7525 while the presnt pension approve is 7085.
Naik:5200+2400+2000+1400+120=11120x70%=7784 compared to 7590 approved pension.
Havildar: 5200+2800+2000+1400+120=11520
x70%=8064 compared to 8064 approved pension
Nb Sub.:9300+4200+2000+1400=16900
x70%=11830 compared to Rs 11510 approved pension.
Subedar: 9300+4600+2000+1400=17300
x70%=12110 compared to Rs 13105 approved pension.
Sub. Major: 9300+4800+2000+1400=17500
x70%=12250 compared to Rs 13450
I would leave it to the readers to make their own assessment of what is sanctioned as compared to OROP if sanctioned as envisaged by us.


Therefore please do NOT be misguided by the PSEUDO LEADERS who claim that OROP suits only OFFICERS & not all the veterans.Of course I did not calculate the pension of say Havildar who retires post 2006 with 30 years of service. Just imagine what would be his pension while he is placed in pay band as on 01 jan 2006 at say 26/27 years of service & his pension amount in comparison with a Havildar with the same length of service but who retired before 01 Jan 2006.
I leave it your judgement to reconcile to the present state of your pension in case you had retired before Jan 2006 or aspire & fight for OROP.

The main demand is that irrespective of the date on which a soldier retires, he or she should get the same pension. “It is a shame for the country that soldiers have to return their gallantry awards and meritorious medals and come to the streets for redressing their grievances,” they said. Dear Colleagues, The Jantar Mantar rally was attended by approximately 2000 ESM and families today. Participants had come from many parts of the country. All compliments to the members of the Governing Body who had done meticulous planning and preparations. Every aspect was thoroughly buttoned up and 35 members took their turn at the mike to give vent to their feelings. A memorandum signed in blood by 6,000 members and addressed to the President was handed over to the Rashtrapati Bhawan. 5,000 medals were also deposited by ESM. It had been decided to hand over the medals personally to the Supreme Commander. The Rashtrapati Bhawan had been informed accordingly. Unfortunately the Supreme Commander did not make it convenient to receive the medals in person. In accordance with the plan and as already decided the team did not hand over the medals to the staff and brought these back. A similar rally was also organized at Bangalore by Colonel Rajan, our indefatigable member. All veterans in the Rally unanimously decided to bring back the medals if her Excellency the President did not receive the medals herself. With a heavy heart the Ex Servicemen did not handover the medals when they found the Supreme Commander did not come to receive their medals herself. Comment: The Govt. should wake up now. Nothing less than OROP will be accepted by the ex-servicemen. Let the Government respect the Supreme Court judgement for equal pension for equal rank irrespective of the date of retirement.

MOD NOTIFICATION OF ENHANCEMENT OF PENSIONS OF JCOS AND JAWANS NO WHERE NEAR GRANT OF ONE RANK ONE PENSION: EX SERVICEMEN MEDALS DEPOSIT PROTEST ON 14 MAR 2010 TO CONTINUE
Dated: 11 March 2010

Dear Members of the Media,

1. Notification issued by the Defence Ministry of the enhancement of pensions of old Defence Pensioners are no where near the grant of One Rank One Pension. The Committee of seven secretaries headed by the Cabinet Secretary did not recommend OROP. It equated the Pre 1997 pensions with Post 1997 and Pre 2006 Pensioners, thus removing a 12 years old anomaly. But the difference between the pre and post 1.1.2006 pensioners stays untouched. After implementation of the above notification, pre 2006 retiree Sepoy with 17 years of service will get a basic pension of Rs 5465 per month, whereas a Sepoy with same years of service who retired after 1.1.2006 is getting Rs 7045/- per month. For subsequent retirees there will be further enhancement of pensions due to the yearly increase of 3 % in the pay scales.

2. Although the Govt had announced in the Parliament on 06 Jul 2009, earmarking of Rs 2144 crores for implementation of enhancement of pensions to remove the 12 years old anomaly, no action to implement this enhancement was taken. It required the prodding by Shri Mr. LK Advani in the Lok Sabha reminding the Govt to fulfill their commitment. The Hon’ble Prime Minister in his reply on 3 & 5 Mar 2010 misinformed the Parliament that the enhancement of pensions of Jawans and JCOs had been implemented as promised while in actual fact the same has now been done on 08 Mar 2010. This indicates an indifferent attitude of the Govt towards the genuine entitlements of Defence Personnel.

3. The apathy shown by the Govt towards the genuine demand of the Ex Servicemen has driven the gallant soldiers to the wall and they have resolved to continue with the protest Movement. Accordingly, the protest scheduled on 14 Mar 2010 at Jantar Mantar New Delhi wherein a delegation led by Lt Gen Raj Kadyan, PVSM, AVSM, VSM, Chairman IESM will hand over the medals and memorandum signed in blood to Her Excellency the President who has been requested to kindly make it convenient to receive the same in person.

4. All members of the media are requested to cover the event extensively to inform the people of India about the mistreatment of Military by the Government.

JUDGEMENT OF THE ARMED FORCES TRIBUNAL, CHANDIGARH

The Chandigarh bench of the Armed Forces Tribunal has directed the Union government to grant one rank one pension or the same pension to personnel belonging to the same rank, irrespective of the date of retirement.

Deciding on the cases of Babu Ram Dhiman vs Union of India and Sohan Singh vs Union of India, the tribunal on Monday said, “It is quite clear that the State cannot lay down different criteria for grant of pension for same rank of officers and Personnel Below Officer Rank (PBOR) on the basis of the cut-off date of retirement. All pensioners, irrespective of the date of retirement are entitled to (the) same pension.”

The judgment also said grant of unequal pay in the same rank was a violation of Article 14 of the Constitution that grants equal rights to all citizens.
The All India Ex-Servicemen’s Welfare Association, Chandigarh, under its legal aid scheme, filed these two cases seeking a direction to the Ministry of Defence to revise the pension of those who retired before January 2006 to put them on par with post-September 2008 pensioners.

Bhim Sen Sehgal, chairman of the association and Rajesh Sehgal, petitioners’ counsel, submitted that a Havildar who retired before January 2006 gets a pension of Rs 4,060 per month while those retiring after September 2008 get Rs 7,846. Similar are the cases of equivalent ranks of the Army, Navy and Air Force, they said.

Amar Preet Sandhu, the central government’s lawyer maintained that the matter was under the government's consideration.

CALL FOR SURRENDERING MEDALS ON 14.03.10

A NATION THAT DOES NOT REMEMBER THOSE WHO, LAID DOWN THEIR LIVES FOR IT CANNOT ALWAYS REMAIN A NATION WORTH DYING FOR.

THE GALLANTRY AWARDS HAVE NO VALUE, IF THE GOVT. DOES NOT CARE FOR THE PRESENT AND PAST SOLDIERS.

Dear All,

You are all aware of the efforts of IESM to raise the question of OROP through BJP leader Sh LK Adavani ji in the Lok Sabha on 3 March 10. In response to the question raised by Sh Advani ji, PM Sh Manmohan Singh has misled the Lok Sabha in saying that all the commitments made to ex-servicemen have been given. This was a completely incorrect statement as major recommendation of cabinet secretary's report of parity of pension between pre 96 and post 96 retiree JCOs ORs has not been released. GOVERNMENT HAD ALLOTTED RS 2140 CRORES FOR THIS PURPOSE IN THE BUDGET OF 2008-09 BUT HAS NOT ISSUED THE ORDERS FOR PAYMENT OF DUES.

IESM has planned a massive rally on 14 March Sunday at Jantar Mantar. In the rally it is planned to deposit the medals with the President for safe custody as a mark of protest and also sign the memorandum in blood to be given to the President and PM. IESM is expecting a large congregation of ex-servicemen at Jantar Mantar on 14 March 10. Programme is given below:
• Start of the rally at 1000h at Jantar Mantar on 14 March Sunday.
• Address by Speakers.
• Address by the Maj Gen Satbir Singh to the gathering at 1230h.
Deposit of Medals by ex-servicemen from 1000h to 1400h.
• Signing the Memorandum in blood from 1000h to 1300h, for handing over to the President, PM and RM.
• Collection of memorandum signed by the ex-servicemen from the states representatives.
• Three teams will be formed out of the present ex-servicemen for going to President, PM and RM's office. Teams will leave for three locations at 1400h.

Following arrangements are planned at the venue of the rally. These arrangements will cost lot of money. IESM is looking for sponsors to fund all these programmes. IESM is thankful to all those veterans who will volunteer to fund any of the programme.
• Tent and Shamiana at the location approx ex Rs 40000.
• Water arrangement at the location approx ex Rs 3000.
• Tea and Biscuit arrangement at the location approx ex Rs 8000.
• Lunch packet for around 1000 persons @ Rs 15/ person Rs 15000.
• PA system and loud speakers approx ex Rs 10000.
• Arrangement for signing the memo in blood, this included disposable syringes, anti coagulant chemicals and other equipment approx ex Rs 15000.
• Photostatting and other admin arrangements approx ex Rs 10000.
• Reimbursement for travel to the ex-servicemen coming for the rally from distant locations (depending on the number of participants).

Approximate expenditure is likely to be around Rs 2 lacs for this rally. Veterans are requested to arrange and sponsor buses from their areas/villages/towns to ferry the ex-servicemen. Veterans are also requested to choose any of the above event and sponsor it. IESM profusely thanks all veterans who wish to sponsor and contribute for the rally.

WE CAN SUCCEED ONLY IF ALL THE VETERANS PUT THEIR MIGHT IN THE FORM OF FUNDS AND VALUABLE TIME FOR THIS PROTEST. GOVERNMENT IS NOT GOING TO LISTEN UNLESS WE SHAKE THE GOVT WITH SHEAR NUMBERS. SO ALL VETERANS ARE REQUESTED TO DONATE GENEROUSLY AND BE PRESENT FOR THE RALLY ON 14 MARCH SUNDAY. EVERY VETERAN IS REQUESTED TO BRING AT LEAST 5 VETERANS ALONG WITH HIM.

1. The Executive Committee of the All India Defence Brotherhood (Regd) in a meeting today strongly deplored the answer given by the Prime Minister to a question raised in the Parliament on 03 March by Hon’ble Shri LK Advani, Chairman of the NDA, as to why the "One Rank One Pension" (OROP) had not been implemented. The Hon’ble Prime Minister, Dr. Manmohan Singh made a WRONG statement on the floor of the House, which was telecast live by the Lok Sabha TV Channel, that the enhancement of pensions to JCO’S and Jawans announced by the Govt on 06 July 09 had been implemented.


2. The fact is, till today, NO Jawan or JCO has received due enhancement of their pensions. Even the Service HQs, where an inquiry was made, have confirmed that NO orders for enhancement of pensions of JCOs and Jawans, as announced by the Govt on 06 July 2009 have been received. Only the fifth Pay Commission (pre- 1996) retirees have been brought closer to post 1996 retirees. PARITY BETWEEN PRE AND POST 6TH PAY COMMISSION RETIREES HAS NOT BEEN ADDRESSED AT ALL. To cover up his govt’s neglect of the defence forces, the PM blatantly accused Mr Adavani of trying to create a rift between the govt and the Defence Forces by raising such a question, even though it was a most pertinent one for the ‘Morale’ of the latter, which is a ‘Battle Winning’ factor.


4. As per the Hon’ble Supreme Court’s ruling, ‘Pension’ is ‘Deferred Wages’ for the ‘Services Rendered’ (earlier). Irrespective of their date of retirement, two persons who rendered the same service, both in terms of ‘Quality’ and ‘Quantity’ should get the same ‘Deferred Wages’ (Pension). In the Defence Forces the ‘Quality’ of service is defined by the ‘Rank’ attained and the ‘Quantity’ by the length of service under similar ‘Determinants’ of Pension. Hence the demand of the OROP, which goes back to 1980s and had been accepted ‘in Principle’ by many Prime Ministers including Mrs Indira Gandhi, Mr VP Singh and Mr AB Vajpayee, etc. Unlike the Civilians, the Soldiers are the only people whose everything depends upon “Ranks”, whether it be, age of retirement, length of service in a ‘Rank’etc. The world over "Ranks" conform to internationally accepted norms, eg a Battalion is commanded by a Lt Colonel/ Colonel and a ship by a Captain. If everything depends upon "Rank", their pension should also depend upon it, irrespective of their date of retirement. An old Naib Subedar, who has enormous responsibilities, gets LESS pension than a newly retired Civilian ‘Chaprasi’ (Peon). An old Sepoy gets much less than a newly retired Sepoy. IS THIS JUSTICE?


5. Mrs Sonia Gandhi, the Congress President promised, in a vast Ex-Servicemen’s "Rally" in November 2002, to grant them One Rank One Pension if voted to power. Tragically that promise has NOT been fulfilled. Reference to OROP was also made in their 2004 election manifesto.


6. The ‘Standing Committee on Defence’ (13th Lok Sabha) in its 20th Report had strongly recommended implementation of OROP and even to make a ‘Precedent’ in this regards. This Report was tabled in both the houses of the Parliament by December 2003. It thus has the sanction of the Parliament. But unfortunately it has not been implemented till date. Denying the OROP at this stage is gravely unjust.


7. Misguiding the Parliament and the Nation, by no less a person than the Hon’ble Prime Minister of India, is a very serious matter of impropriety. The Bureaucrats have again connived by wrongly advising the Prime Minister, which is condemnable. We strongly protest and request the PM to honour the commitments made on One Rank One Pension.
