GRANT OF DUAL FAMILY PENSION

GRANT OF DUAL FAMILY PENSION


As per the provisions of Min of Personnel, Public Grievances and

Pensions, Deptt of P&W OM No. 1/19/96-P&PW(E) dated 27 Jul 2001, the

families of the Govt. servants who are in receipt of family pension under

the Employees Pension Scheme 1995 and the Family Pension Scheme

1971, shall be eligible for family pension from Central Govt, in addition.


Accordingly the Min of Defence vide their letter No.

2/CC/B/D(Pen/Sers)/2001 dated 28 Aug 2001 has extended the above

provisions of Deptt. Of P&PW OM dated 27 Jul 2001, mutatis/ mutandis to

Armed Forces Personnel who were re-employed in the organisation/

establishments where Employess Pension scheme 1995 and

Family Pension Scheme1971 are in force. However, these orders will be

applicable with effect from 27 Jul 2001.


Note: The claimant has to submit the duly signed Re-employment

Certificate Part-I from the re-employer to the Pension Disbursing Authority/

Record Office in order to verify the eligibility of dual family pension. Blank copy

of Re-employment Certificate Part-I is available at AFRO website under Family

Pension heading in Pension and Welfare section.


Comment: The Indian Air Force Website had clarified the grant of dual family pension as given above.


Now the question is What is the difference between Employees Pension Scheme 1995 and the Employees Pension Scheme 1995 of the Nationalised Banks which was introduced in Banks from Nov 1993.


If both the schemes are self sustainable (Yes, it is self sustainable) and does not require any financial support from the Government of India, then why at all the dual family pension is denied to the families of ex-servicemen re-employed in banks.


All the nationalized banks have their own pension scheme called _______Employees Pension Regulations 1995. The scheme does not restrict its family pensioners drawing family pension from any other sources. Then why at all the Air Force Record Office deny the eligible family pension to the widows of ex-airman while the particular bank itself (Canara Bank Head Office) had clarified that there is no prohibition on the family of deceased ex-servicemen employee from receiving family pension from the Bank even if the family is in receipt of family pension from other sources.


All re-employed ex-servicemen bank employees and their families join together and submit a memorandum to the respective record offices for payment of dual family pension without any delay.

The NPS talks about the investment scheme at the present date and for annuity we have to buy from the insurance schemes available at that time of sixty years. If you want to have 'information' regarding the procedure for settlement of the contribution you made to the 'new pension scheme' you have to ask for it from the PIO of the Ministry concerned where you were employed.

Employees covered under Employees' Provident Fund Scheme are eligible for 10 / 12% CPF from the emplyer on their wages / salary, as the case may be, and this amount will be on accumulation basis which will be an assured retirement benefit to such employees. Certain amount from this contribution viz. Rs.541/- (Max.) will be diverted to the EPS'95. Hence, Dual Pension to the Re-employed pensioner has been allowed belatedly though such thing should have been allowed from the date of commencement of EPS;95 i.e. 16-11-1995. It is not known where the contributions of re-employed ex-servicemen have gone from 16-11-1995 to date of eligible for second family pension (2001).

Similarly, re-employed ex-servicemen not covered by EPF / EPS, not eligible for recurring CPF benefit but their families supposed to be extended pensionery benefit for second spell of their spouses' re-employed service in Governemnt Departments as it is a distinct service which ought to be eligible for pension on this account alone after fulfilling the minimum required service for pension eligibility.

Is there any justifiable ground to deny second family pension to the re-employed ex-servicemen category retired from Government Departments?

Would like to hear the comments from the members. No one raising any voice about this.

i am son of retired army person, my father reemployed in Central Bank Of India. My father is no more in this world, my mother got all the the full and final from Bank except the Bank Contribution in PF account of deceased employee. When i put this query to Central office of Bank they responded me that your mother will not get the Bank Contribution rather she is eligible for family pension. i raised the question that my mother has applied for army family pension then they replied that your mother will get family pension regardless whether is getting other family pension or not. she also advice me to ask from army pension disbursing offices about it. Now question is Bank is ready to give Dual family pension but what about army..??

The Cabinet also decided that dual family pension would be allowed in the present and future cases where the pensioner drew, is drawing or may draw pension for military service as well as for civil employment.
