  2. The Dearness Relief rates payable from 1.1.2006 are as follows:-

From Jan 2006 to Jun 2006 - Nil

From Jul 2006 to Dec 2006 - 2%

From Jan 2007 to Jun 2007 - 6%

From Jul 2007 to Dec 2007 - 9%

From Jan 2008 to Jun 2008 - 12%

From Jul 2008 to Dec 2008 - 16%

Note: The D.R. rates are revised twice every year in Jan & July. The present 16% will be increased to 22% w.e.f. Jan 09 after Govt. approval & orders.

3. As of now the minimum family pension is = Rs.3,500

Dearness Relief @ 16% -- -- = Rs. 560

Fixed medical allowance -- -- = Rs. 100

If any of your neighbor, an old lady, your far away living relatives, any family pensioner for that matter is getting less than this amount as pension (Except some exgratia pension cases) please help them to get their full and correct pension.

Also tell them the amount of 40% arrears will have to be Rs.14,391/-

And the remaining 60% arrears which will be paid later Rs.21,586/-

If any of the family pensioners you come across got less arrears than as indicated above, please help them to get correct amount, otherwise please inform the details to the Blogger with the name, address of the pensioner and the Bank and account number.

If the pensioner’s age is 80 to 85 the min. pension should be Rs.4,872/-

If the pensioner’s age is 85 to 90 the min. pension should be Rs.5,278/-

If the pensioner’s age is 90 to 95 the min. pension should be Rs.5,684/-

If the pensioner’s age is 95 to 100 the min. pension should be Rs.6,090/-

If the pensioner’s age is above 100 the min pension should be Rs.8,120/-

I hope this information will be of much help to the aged family pensioners, also you will have satisfaction that you have helped some one. Pray God, your grand parents to live longer to get more pension. Please look after them well with the help of this pension. If any of the aged pensioner is unable to get their date of birth, try to convince the Banker with their voter identity cards, exservicemen identity cards, esm widows identity cards (Pink colour card) or civil family cards etc.

Clarification/Confirmation required on revision of Defence Family Pension as per Annexure I, II and III of Govt. letter dated 11/11/2008.

Most of the Defence Family Pensioners (Specially PBOR family pensioners) are not aware that their family pension is based on their husband’s Rank and Group. Therefore they are not in a position to verify the correctness of the pension paid to them. There are many cases, that a widow of a Subedar Group ‘A’ is paid a family pension payable to the widow of a Sepoy. This situation is prevailing in many bank branches.

The minimum family pension has been fixed at Rs.3,500/- upto the rank of Havildar and equivalent ranks in Navy & Air Force irrespective of GP and number of years of service etc.

Similarly, for other ranks, the Ordinary family pension as per Annexure I and II and III are different.

For example, a widow of a Nb.Sub.(Group ‘A’) will get Ordinary family pension (Normal Rate) under modified parity w.e.f. 1.1.96 is Rs.1,560/-.

If this Rs.1,560 is revised as per Annexure I it will be -- Rs.3,526

Whereas if it is revised as per Annexure III, it will be -- Rs.5,070

Similarly, a widow of a Hon.Lt. will get Ordinary fmily pension (Normal rate) under modified parity w.e.f. 1.1.96 is Rs.3,150/-.

If this Rs.3,150 is revised as per Annexure I, it will be -- Rs.7,119

Whereas if it is revised as per Annexure III, it will be -- Rs.8,100

The Govt. order dt.11/11/2008 says to adopt the table Annexure I or II or III whichever is beneficial to the family pensioner. It has been observed that none of the PDAs have given effect to this beneficial clause while revising the pension of the defence family pensioners. I am submitting herewith a ready reckoner to show the difference in the revised family pension as per Annexure I and Annexure II (For Officer’s families) and Annexure III (For PBOR families).

* In cases of widows of Majors, Lt. Col (TS) and Lt.Col (S) Annexure I is beneficial. As per the above ready reckoner, it is evident that the Annexure II is beneficial to all family pensioners except the widows of Majors, Lt.Cols(TS) and Lt.Cols(S).

The revision of family pension in respect of PBOR Family pensioners is based on their Rank and Group. The PDAs are finding it difficult to find out the Rank and Group of the deceased PBOR. Also their families are not in a position to show the relevant personal records to prove Rank and Group as a result, most of the PBOR family pensioners are paid the minimum family pension of Rs.1,275. We have come across many widows of Subedars, Subedar Majors, Hon. Lts. are drawing minimum family pension of Rs.1,275. Neither the widow is aware of her correct pension, nor the Bank branch is bothered about payment of correct pension to the widows.

Now let us see the family pensions of PBORs.

Some guidelines to PDAs revising Disability Pension.

Guidelines to PDAs while revising the pension of a Defence pensioner who is drawing Service Element and Disability Element.

Refer Ministry of Defence letter No.17(4)/2008(1)/D (Pen/Policy) Department of Exservicemen Welfare, New Delhi 110 011 dt.11/11/2008 para 9 and 9.1.

It has been reported by many pensioners(Specially PBORs) who are drawing Service Element and Disability Element, that their pension has been revised in a non-beneficial manner by the PDAs. Also they are unable to convince the Bankers, therefore the incorrect revision of pension continues. Here I am trying to explain in simple terms so that the readers of this Blog will be able to help the needy and if possible convince the PDAs.

For Example if a Sepoy is drawing in the pre-revised scale as follows:-

Service element of pension.. ... .... ... Rs.1,275 (without D.P.)
Disability element @ 20% .. ... ..... ... Rs. 310 (without D.P.)

His pension will have to be revised as follows:-

As per Annexure I B.P from 1275 to 1548 .. .. = 3500

Any pre-revised pension drawn between 1275 to 1548 is to be revised to Rs.3,500/-

The Disability drawn in isolation should be added to the pre-revised cut off figure for Rs.3,500 i.e. Rs.1,548. Therefore, the 20% disability at the pre-revised rate of Rs.310 is to be added with Rs.1548 and a new revised pension is to be arrived as an interim measure as per the Govt. letter. This is the correct method to be followed for revising the pension.

Whereas some PDAs have added Rs.310 with Rs.1275 and arrived at Rs.1585 as prevised basic pension and revised the pension to Rs.3583 instead of adding the 310 with 1548 for a pre-revised pension of Rs.1858 and revised pension of Rs.4,200/-.

The method adopted by the PDAs resulted in a revised pension of Rs.3583 instead of Rs.4,200 which is incorrect and resulted in a reduction in the revised basic pension by Rs.617 and Rs.715 when D.R. is added.

As per para 9.1 of the said government order, the revised disability pension (interim) for 100% disability is Rs.3,500 accordingly, the revision will be Rs.3,500 for Rs.1275 and Rs.700 for Rs.310 thus the total will be 3500 + 700 = Rs.4200 and not Rs.3583 as done by most of the Centralised Pension Processing Cells of the Banks.

The readers of this Blog may kindly take note and help the concerned pensioners accordingly. This clarification is given following a number of complaints against the Pension Disbursing Agencies who have adopted non-beneficial method of revision.

6th CPC & the Supreme Court Judgement.

Let us recall few lines of the famous D.S.Nakra's case Judgement of the Supreme Court.

Supreme Court.(1983/SCC/205U305)No.5939-5941/1980) D.S.Nakra and other vs UOI. (AIR 1983, SC 130)

This judgment of 17-12-1982 on this case, is a landmark in the evolution of the pension structure for past pensioners and in the history of pensioner' movement. It was on this day that the Supreme Court spelt out the Magna Carta of Pensioners. It gave the pensioners a new lease of life. It bestowed dignity and status to the pensioners. For pensioners, that has become the law of the land. That is why 17th of December of every year is celebrated all over India as "Pensioners' Day".

Shri D.S.Nakra, the Petitioner of the case was the Financial Advisor to Ministry of Defence, Government of India in 1971.

The judgement says:-

"that Pension is not a bounty nor a matter of grace depending upon the sweet will of the employer. It is not an ex-gratia payment, but a payment for past services rendered. It is a social welfare measure, rrendering socio-economic justice to those who in the hey days of their life, ceaselessly toiled for their employers on an assurance that in their old age, they would not be left in the lurch".

"It is State's obligation to provide security in old age, ......pension is not in the nature of alms being doled to beggars. Pension is their deferred wage. Pension is their statutory, inalienable and legally enforceable Right and it has been earned by the sweat of their brow. The Senior Citizens need to be treated with dignity and courtesy befitting their age"

Pension is not only compensation for loyal service rendered in the past, but pension has also a broader significance, in ther it is a measure of socio-economic justice which inheres economic security in the fall of life, when physical and mental process is ebbing corresponding to aging process and, therefore one is required to fall back on savings...........

A Pension scheme consistent with available resources, must provide that a pensioner would be able to live free from want, with decency, independence and self respect, at a standard of living equivalent to the pre-retirement level........

By this judgment, the court has held that the GOI cannot pick a date from a hat and implement its orders. It follows from this judgment, that for equal service in the same post and for same length of total service, there should be no unequal treatment in the matter of pension, merely because their date of retirement are different. It also brings out that any classification of pensions, based on retirement date, is invalid and any liberalization granted to subsequent pensioners (who retired later) is automatically admissible to the earlier retired pensioners as well.

While the 4th and the 5th Central Pay Commissions had respected the Supreme Court judgement, why the 6th CPC had ignored the Judgement.?

Shall we approach the Supreme Court again ? Then What is the solution ? The Defence pensioners are the most affected lot in this discrimination of pre 2006 and post 2006 pension fixation. Let us all join together and think what should be done ?
