Old people are often more ready to accept their own approaching death than are those who love them.  Persons who have lived fully are not usually afraid to die.  Death is, after all, the natural end of life.

We often make the mistake of trying to keep a dying person alive as long as possible, no matter what the cost.  Sometimes this adds to the suffering and strain for both the person and his family.  There are many occasions when the kindest thing to do is not to hunt for ‘better medicine’ or a ‘better doctor’ but to be close to and supporting of the person who is dying.  Let him know that you are glad for all the time, the joy and sorrow you have shared, and that you, too, are able to accept his death.  In the last hours, love and acceptance will do for more good than medicines.

Old or chronically ill persons would often prefer to be at home, in familiar surroundings  with those they love, than to be in a hospital.  At times this may mean that the person will die earlier.  But this is not necessarily bad.  We must be sensitive to the person’s feelings and needs, and to our own.  Sometimes  a person who is dying suffers more knowing that the cost of keeping him barely alive causes his family to go into debt or children to hunger.  He may ask simply to be allowed to die – and there are times when this may be the wise decision.

Yet some people fear death.  Even if they are suffering, the known world may be hard to leave behind.  Every culture has a system of beliefs about death and ideas about forms of life after death.  These ideas, beliefs, and traditions may offer some comfort in facing death.

Death may come upon a person suddenly and unexpectedly or may be long awaited.  How to help someone we love accept and prepare for his approaching death is not an easy matter.  Often the most we can do is offer support, kindness, and understanding.

The death of a younger person or child is never easy.  Both kindness and honesty are important.  A child-or anyone-who is dying often knows it, partly by what his own body tells him and partly by the fear or despair he sees in those who love him.  Whether young or old, if a person who is dying asks for the truth, tell him, but tell him gently, and leave some room for hope.  Weep if you must, but let him know that even as you love him, and because you love him, you have the strength to let him leave you.  This will give him the strength and courage to accept leaving you.  To let him know these things you need not say them.  You need to feel and show them.

We must all die.  Perhaps the most important job of the healer is to help people accept death when it can or should no longer be avoided, and to help ease the suffering of those who still live.

 DEFENCE PENSION GUIDE BOOK IN HINDI

Language plays a vital role in uniting the people under one umbrella for a common cause.  The Indian Ex-servicemen Movement was formed mainly with the help of the Blog called “Report My Signals”.  The creator of the Blog Brig. Kamboj and the Moderator of the Blog  Lt.Col. James Kanagaraj have done excellent work to form this wonderful organization called IESM.

Since the language used in this Blog is only English and therefore only English speaking officers only could join and interact with this organization.  The vast majority of Hindi speaking other ranks are unable to participate because of lack of internet knowledge and English.

It is very essential that the IESM should start a Blog in Hindi for the benefit of vast majority of Other Ranks.  Simultaneously the IESM should start publishing monthly journal and simple guide books in Hindi in Defence pension, ECHS etc., for the general reading of these personnel.

In order to assist the IESM in publishing a pension guide book in Hindi, the Exwel Trust had written a simple pension guide book in Hindi and sent it to IESM HQ for their perusal, opinion & approval.  On receipt of reply from the IESM HQ, the book will be published very soon.  It may be noted that the Exwel Trust had written few books on Defence Pension and ECHS in Tamil.  The feedback from the readers shows that the books are very useful.  We hope that this pension book in Hindi will be very useful to every defence pensioner, specially the other ranks and their families in understanding the defence pension for using in their day to day life.

MESSAGE FROM IESM CHAIRMAN

Dear Colleagues,

          This is to wish all the Veterans and their families a Merry Christmas. May your life be joyous and fulfilling?

          I met the Defence Minister today. The two main issues discussed were:

1.    OROP - Petitions Committee Report The MoD has not yet received copy of the report; he called up his staff to obtain it from the Parliament. (I had carried a soft copy and gave it to his office later).  I expressed apprehension that while processing the report, officialdom may place some hurdles. Some of these obstacles, on which I forewarned him,  could be:

‘If we give OROP to the Defence Forces, others would also demand it thus raising the financial burden manifold’.  This line of thought has already been preempted and checkmated by the Petitions Committee themselves. I further highlighted that in the past whenever Defence-specific benefits were given – such as Rank Pay, MSP – there was no protest or a call for similar benefits from civilian employees.

‘The Defence Forces pensioners seeking OROP would demand its applicability from 1.1.2006 and the cost of arrears would be unacceptable’. I gave the example of the Madan Lal Khurana led Parliamentary Standing Committee that in 2003 had computed the cost of grant of OROP as 613.78 Crore. However, while processing the report the bureaucracy pointed out that the pensioners would seek arrears from 1996 and the cost would be unacceptable.  I assured the Minister that the IESM is basically pursuing the acceptance of concept of OROP and would accept its applicability prospectively from the date of issue of government orders.

‘Since it is already accepted that the Defence Forces would have a separate pay commission from Seventh Central Pay Commission onwards, OROP could be deferred till that time’.   I categorically stated that this would tantamount to merely delaying the decision and would not be acceptable to the ESM and their struggle would further intensify.  I reiterated that the Petitions Committee report also makes the same point by seeking OROP at the earliest and a separate pay commission for Defence Forces from next CPC.

The Minister noted all the above. However, since the MoD has not received the report, he made no comments.

2.    Enhancement of Widows Pension. The Minister himself touched upon this point and again clarified – what he had told me on telephone on 23 November 2011 - that the Defence Ministry has already cleared this and the case is now with the Finance Ministry. While thanking him I also requested him to use his good offices and pursue the case with the Finance Ministry. He promised he would. On my seeking, he disclosed that the expenditure involved is about 150 or 160 Crores.

பாதுகாப்பு படையினருக்கான தீர்ப்பாயம்

நீதிக்கான போராட்டத்தை தாமதபடுத்துவது,  நீதியை தோல்வி காண செய்வதற்கு சமமாகும்.  நீதி நிலை நாட்டப்படுவது   என்பது எவ்வளவு முக்கியமோ அதேபோல் அது நிலை நாட்டப்படுவது   போல் நடவடிக்கையவது மேற்கொள்ளவேண்டும் என்பது அதைவிட முக்கியம்.  காலம் கடந்து கிடைக்கும் நீதி, நீதிக்கும் நேர்மைக்கும் மாபெரும் தோல்வி ஆகும்.

பாதுகாப்பு படையினருக்கான தீர்ப்பாயம் காலத்தின் கட்டாயம்.  உலகத்தின் நாலாவது மிகப்பெரிய ராணுவத்தை கொண்டுள்ள இந்திய ராணுவத்தின் உயர்ந்த நீதி மன்றங்கள் (Court Martials) அளிக்கும் தீர்ப்புகள் பெரும் சர்ச்சைக்கு உள்ளாயின.  தூக்கு தண்டனை வழங்க வேண்டும் என்ற முடிவுக்கு வந்துள்ள இந்த உயர் ராணுவ நீதி மன்றம் அதற்க்கான சரியான காரணத்தை பல தீர்ப்புகளில் வெளியிடாதது ஒரு மாபெரும் அநீதி.  இந்த நிலை தொடர்ந்தால் இந்திய ராணுவத்தில் நீதி கிடைக்காது என்ற எண்ணம் பரவி விடும் என்ற பயம் நாட்டின் உச்ச நீதி மன்றத்தின் பார்வைக்கு வந்தது.

ராணுவ நீதி மன்றங்களின் தீர்ப்புக்கு மேல் முறையீடு என்பது சீசர் வழங்கிய தீர்ப்புக்கு அவர் மனைவியிடம் மேல் முறையீடு செய்வதற்கு சமமானது என்று கருதியது நம் நாட்டின் உச்ச நீதி மன்றம்.  ராணுவத்தில் பணியாற்றுபவர்கள் அனைவரும் இந்திய குடிமகன்கள்.  நமது அரசியலமைப்பு சட்டத்தின் பயன்கள் அவர்களுக்கும் கிடைக்கவேண்டும் என்ற எண்ணத்தில், ராணுவ உயர் நீதிமன்றங்களின் தீர்ப்புகளுக்கு மேல் முறையீடு செய்யும்போது ஏதேனும் ஒரு சிவில் நீதிமன்றங்களை சார்ந்தவர்கள் முன்னிலையில் முறையிடும்போது, மேல் முறையீடுகள் அர்த்தமுள்ளதாக இருக்கும் என்று நம்பப்பட்டது.

ராணுவ கட்டு பாட்டுக்காகவும், ஒழுக்கத்துக்கவும், நீதியை தியாகம் செய்யமுடியாது.  (We cannot sacrifice justice for the sake of military discipline) என்பது எல்லோராலும் ஒப்புகொள்ளகூடியது.  சில நீதி நேர்மையற்ற முடிவுகள் ஒட்டுமொத்த ராணுவ ஒழுக்கத்தைகூட பாதிக்கும்.  எனவே பணிபுரியும் அனைத்து ராணுவத்தினருக்கும், பணி விலகி வந்தவர்களுக்கும் உரிய நீதி கிடைக்க வேண்டி 15.06.2008 முதல் பாது காப்பு படையினருக்கான தீர்ப்பாயம் நிறுவப்பட்டது.  தற்போது நாடெங்கிலும் பரவலாக ஒன்பது இடங்களில் இந்த தீர்ப்பாயங்கள் இயங்கி வருகின்றன.

புது டில்லியில் உள்ள முதன்மை பெஞ்சில் (Principal Bench) 2406 வழக்குகள் பதிவாயின.  இதில் 1525 வழக்குகளுக்கு தீர்ப்பு வழங்கப்பட்டது.  இதே போல் சண்டிகர் தீர்ப்பாயத்தில் 2530 வழக்குகள் பதிவாகி 1325 வழக்குகளுக்கு தீர்ப்பு வழங்கப்பட்டது.  மேலும் இந்த தீர்ப்பாயங்கள் கையாண்டுள்ள பல வழக்குகளில் இருந்து ஒன்று மட்டும் தெளிவாக தெரிகிறது – அதாவது – நமது முன்னாள் படைவீரர்களின் ஒற்றுமையின்மையாலும், இந்த பல்லாயிர கணக்கான ராணுவ வீரர்களின் பொதுவான பிரச்சனைகளை ஒன்று படுத்தி ஒரு குடையின் கீழ் கொண்டு வந்து, அகில இந்திய அளவில் ஒரு சங்கமோ அல்லது ஒரு சம்மேளனமோ எடுத்து வழக்காட முடியாமல், பாதிக்கப்பட்ட பலரும் தனித்தனியே இந்த நீதி மன்றங்களை நாடுவது ஒரு பெரிய பலவீனம்.  இதை தவிர்க்க நல்ல பெரிய முன்னாள் ராணுவத்தினர் நல சங்கங்கள் முன் வர வேண்டும்.

பணியில் இருக்கும் ராணுவத்தினருக்கும், முன்னாள் ராணுவத்தினருக்கும் இந்த தீர்ப்பாயங்கள் ஒரு மாபெரும் வரப்பிரசாதம்.  தாமதமின்றி நீதி கிடைக்க இந்த நீதி மன்றங்கள் பெரிதும் உதவியாக உள்ளன.  அதே நேரத்தில் இதுவரை இந்த நீதிமன்றங்கள் வழங்கியுள்ள 4729 தீர்ப்புகளில் பத்து சதவீதம் கூட இன்னும் அமுல் படுத்த படவில்லை, என்று இந்த தீர்ப்பாயத்தின் தலைவர் மாண்புமிகு நீதிபதி திரு A.K.மாத்தூர் அவர்கள் கூறுகிறார்.  இதற்கு என்னதான் தீர்வு.  அரசியலமைப்பு சட்டத்தின் படியும், பாராளுமன்றத்தின் ஒப்புதல் படியும் நிறுவப்பட்ட இந்த தீர்ப்பாயம் வழங்கிய ஆயிரக்கணக்கான நல்ல நல்ல தீர்ப்புகள் ராணுவ அமைச்சகத்தின் வித்தியாசமான பார்வையால் அமுல் படுத்தபடாமல் கிடப்பில் போட பட்டுள்ளன. அரசின் நிர்வாக இயந்திரம் முழுமையாக ஒத்துளைத்தால்தான் இந்த நீதி மன்றங்களின் செயல்பாடுகள் பயனுடையதாக இருக்கும்.

நல்ல நல்ல தீர்ப்புகளை நீதிமன்றங்கள் தனக்கு விடும் சவாலாக அரசு நிர்வாக இயந்திரம் எடுத்து கொள்ளாமல் அமுல் படுத்த ஆவன செய்யவேண்டும்.  மேல் முறைஈடுகளுக்கு வரைமுறைகள் இருந்தும் பல தீர்ப்புகள் மேல் முறையீடு என்ற போர்வையில் காலம் தாழ்த்தப்படுகிறது.

ஒரு சாதாரண படை வீரன் நீதி வேண்டி இந்த நாட்டின் உச்சநீதி மன்றம் வரை செல்ல வேண்டியது துரதிர்ஷ்ட வசமானது.  மேலும் இந்த தீர்ப்பாயங்கள் கையாண்டுள்ள பல வழக்குகளிருந்து ஒன்று மட்டும் தெளிவாக தெரிகிறது.  அதாவது – நமது முன்னாள் படை வீரர்களின் ஒற்றுமை இன்மையாலும், இந்த பல்லாயிரகணக்கான ராணுவ வீரர்களின் பொதுவான பிரச்சனைகளை ஒன்று படுத்தி ஒரு குடையின் கீழ் கொண்டு வந்து அகில இந்திய அளவில் ஒரு சங்கமோ அல்லது ஒரு சம்மேளனமோ எடுத்து வழக்காட முடியாமல், பாதிக்கப்பட்ட பலரும் தனித்தனியாக இந்த நீதி மன்றங்களை நாடுவது ஒரு பெரிய பலவீனம்.  இதை தவிர்க்க நல்ல பெரிய முன்னாள் நல சங்கங்கள் முன் வரவேண்டும்.

தவிர இந்த முன்னாள் ராணுவத்தினர் சம்பந்தமான வழக்குகளை கையாள பெரும்பாலும் ராணுவத்தில் பணியாற்றி வெளிவந்த வழக்கறிஞர்களை நாடவேண்டி உள்ளது.  இதேபோல் அரசும் சட்டம் படித்த ஒய்வு பெற்ற ராணுவ அதிகாரிகளையே அரசு சார்பாக வாதாட நியமிக்கிறது.  குறுகிய காலத்தில் அதிகமான வழக்குகள் தாக்கல் செய்ய படுவதாலும், பிரத்தியேகமான வழக்கறிஞர்கள் கிடைக்காத காரணத்தால் சாதாரண படை வீரர்கள் பெரும் தொகை செலவு செய்து இந்த நீதி மன்றங்களை அணுக அஞ்சுகின்றனர்.

பல நூற்றுகணக்கான ராணுவ குடும்ப பென்சன் வாங்கும் விதவைகள் தன் பென்சன் குறைபாடுகளை இந்த நீதி மன்றங்களில் முறையிட்டால் கட்டாயம் வெற்றி கிடைக்கும் என்று தெரிந்தும், இந்த செலவினங்களை நினைத்து அப்படியே விட்டு விடுகின்றனர்.

உதாரணத்துக்கு வங்கியில் மறு பணியில் சேர்ந்து இறந்து போன படை வீரர்களின் விதவைகளுக்கு இரண்டு குடும்ப பென்சன் வழங்கலாம் என பல தீர்ப்புகள் வந்துவிட்டது.  இந்த தீர்ப்புகளின் சாரம்சத்தின்படி  பாதிக்கப்பட்ட அனைத்து விதவைகளுக்கும் இரண்டு குடும்ப பென்சன் இந்த அரசு ஆணையிடலாம்.  அனால் நடைமுறையில் ஒவ்வொரு விதவையையும் நீதி மன்றத்துக்கு செல்ல தூண்டுகிறது இந்த அரசு.  இது ஒரு நல்ல நிர்வாகத்துக்கு அழகல்ல.

நீதி மன்றங்களும், அரசு நிர்வாக இயந்திரமும் இணைந்து செயல் பட்டால்தான் பாதிக்கப்பட்டவர்களுக்கு உரிய பயன் விரைவில் கிடைக்கும்.  குறிப்பாக ராணுவ அமைச்சகம் (MOD) தனது போக்கை மாற்றி இந்த நீதி மன்றங்களின் தீர்ப்புகளை அமுல்படுத்த உடனே ஆவன செய்ய வேண்டும்.
