WAR WIDOWS PENSION (REVISED)



LIBERALISED FAMILY PENSION (OTHER RANKS)

1.      Liberalized family pension (LFP) will be granted to the next of kin of Other Ranks who is killed in war or war like conditions. (MOD letter No.1(2)/97/D/(Pen-C) dt.31.01.2001.

2.      Liberalized family pension will be at the rate of last pay drawn by the deceased.

3.      This benefit is extended to NOK killed in all operations from 1947-48 onwards.

4.       Liberalized Family pension came into existence from 01.02.1972 onwards.

5.       PPO for liberalized family pension will start with F/BC series (viz.,BC=Battle Casualty) eg. F/BC/2352/1999.

6.       Remarriage by the widow will NOT be a disqualification and she can continue to draw liberalized family pension.

7.       LFP is granted for the benefit of the entire family.  Therefore, if the recipient does not support other dependent family members, the competent authority (based on an investigation from Army Recruiting Office) may at his own discretion, divide the LFP in such ration as he deems fit.

8.       Second Life award is also admissible in LFP.  For details refer www.pcdapension.nic.in

9.       Dearness Relief is also admissible in addition.

       The Government orders for up-to-date revision of LFP was issued only on 18.3.2011 by CDA(P) Allahabad (Circular No.456).  According to this the LFP of a Infantry soldier GP ‘D’ is to be revised from Rs.2985 to 6747 by Jan 2009 w.e.f. 01.01.2006 (MOD letter dt.11.11.2008) and again now as per CDA Cir.456 it should be further revised to from Rs.6747 to Rs.9200 w.e.f. 01.01.2006.

       This complex procedure of monitoring this poor widow’s pension by the PDAs goes unnoticed in many cases.  Many widows continue to draw unrevised rate of pension despite availability of orders with the PDAs.  For the benefit of the Widows who are drawing LFP, we are publishing the rates of revised LFP payable to them w.e.f. 01.01.2006.  The rates are equally applicable to all equivalent ranks in Navy and Air Force. (Table No.3 of Cir.456)

Note: As on today, a Widow of an Infantry Soldier (Gp.’D’) drawing LFP should get a total monthly pension of Rs.13,892. (Excluding medical allowance)  Please help those who are not getting correct pension.

JAN LOKPAL BILL

Existing System
No politician or senior officer ever goes to jail despite huge evidence because Anti Corruption Branch (ACB) and CBI directly come under the government. Before starting investigation or prosecution in any case, they have to take permission from the same bosses, against whom the case has to be investigated.

System Proposed by civil society
Lokpal at centre and Lokayukta at state level will be independent bodies. ACB and CBI will be merged into these bodies. They will have power to initiate investigations and prosecution against any officer or politician without needing anyone’s permission. Investigation should be completed within 1 year and trial to get over in next 1 year. Within two years, the corrupt should go to jail.

No corrupt officer is dismissed from the job because Central Vigilance Commission, which is supposed to dismiss corrupt officers, is only an advisory body. Whenever it advises government to dismiss any senior corrupt officer, its advice is never implemented.

System Proposed by civil society
Lokpal and Lokayukta will have complete powers to order dismissal of a corrupt officer. CVC and all departmental vigilance will be merged into Lokpal and state vigilance will be merged into Lokayukta.

No action is taken against corrupt judges because permission is required from the Chief Justice of India to even register an FIR against corrupt judges.

Lokpal & Lokayukta shall have powers to investigate and prosecute any judge without needing anyone’s permission.

There is so much corruption within CBI and vigilance departments. Their functioning is so secret that it encourages corruption within these agencies.

All investigations in Lokpal & Lokayukta shall be transparent. After completion of investigation, all case records shall be open to public. Complaint against any staff of Lokpal & Lokayukta shall be enquired and punishment announced within two months.

Weak and corrupt people are appointed as heads of anti-corruption agencies.

System Proposed by civil society
Politicians will have absolutely no say in selections of Chairperson and members of Lokpal & Lokayukta. Selections will take place through a transparent and public participatory process.

Citizens face harassment in government offices. Sometimes they are forced to pay bribes. One can only complaint to senior officers. No action is taken on complaints because senior officers also get their cut.

System Proposed by civil society
Lokpal & Lokayukta will get public grievances resolved in time bound manner, impose a penalty of Rs 250 per day of delay to be deducted from the salary of guilty officer and award that amount as compensation to the aggrieved citizen.

Nothing in law to recover ill gotten wealth. A corrupt person can come out of jail and enjoy that money.

Loss caused to the government due to corruption will be recovered from all accused

Small punishment for corruption- Punishment for corruption is minimum 6 months and maximum 7 years.

System Proposed by civil society
Enhanced punishment - The punishment would be minimum 5 years and maximum of life imprisonment.

PENSION MELA AT AIR FORCE STATION, TAMBARAM
EXWEL TRUST JOINS THE MELA IN TAMBARAM

A pension mela was conducted at Air Force Station, Tambaram on 11.08.2011 by our Ex-servicemen Helpline Centre, Chennai.  Our Chief Liaison Officer, Sgt.S.Kandiah (Retd.) was deputed to join the mela.

The Air Force Association at Tambaram extended full co-operation for the successful conduct of the pension mela by providing all help including Place, furniture, refreshment and moral support. 

We sincerely thank Gp.Capt.V.Palanisamy, (Retd.) President, AFA Tambaram Chapter and other office bearers of AFA Tambaram.  More than 35 pensioners got their pension entitlement clarified and about 6 pensioners had discrepancy for which we have guided them accordingly.

All the participants and the AFA Tambaram appreciated the program arranged by the Ex-servicemen Helpline Centre, particularly, the Officer i/c Hon.Capt.M.David and his team for their keen interest in the programme.  It requested that similar programme may be conducted with advance information to the pensioners.

ARMY TO CUT LITIGATION CASES INVOLVING VETERANS

In a proactive move to reduce litigation, the Army Headquarters (AHQ) has asked all army commands to ensure that contested litigation concerning retired personnel are withdrawn where the issue involved is well settled by previous judgments.

The Adjutant General’s (AG) branch at AHQ has issued directives to officers in charge of litigation at the Armed Forces Tribunal (AFT) and the High Courts that cases involving settled legal position in the favour of veterans should not be contested in courts since it results in unnecessary financial strain on former defence personnel as well as the Union of India.

Sources said this is for the first time that such orders have been issued.
The AG’s branch has also issued specific direction to its officers that cases where medical board recommendations in favour of disabled personnel have been wrongly overruled by administrative authorities should not be contested and should be withdrawn.

The AG’s branch has also directed that cases should also not be contested where individuals with non-service related disabilities are medially boarded out with a little less than 10 years of service which is the minimum qualifying service required for invalid pension in cases of disabilities which are neither attributable to nor aggravated by service conditions.

The AG’s branch has further sensitised military authorities that individuals with non-service related disabilities should not be boarded out if they are nearing the minimum service limit of 10 years for earning an invalid pension. There is no minimum service requirement however to earn disability pension in cases with attributable or aggravated disabilities.


A large number of veterans have welcomed the AG’s directives. In recent times objections were raised by many veterans’ organisations on the tendency of the Defence Ministry of appealing against all pensionary decisions rendered by Courts in favour of defence veterans. “The directions issued by the AG is salutary move that is in line with the National Litigation Policy and which would reduce the burden on poor litigants as well as the courts, leaving time for more complex matters to be litigated,” Maj Navdeep Singh, President of the AFT Bar Association said.

The courts are flooded with pension related litigation, with disability pension claims forming the bulk. While the military authorities per se try to be helpful to disabled personnel, most of the litigation is directed towards non-adherence of rules by medical boards while determining attributability or aggravation of disabilities
and towards the CDA authorities whom veterans say are insensitive to the problems of former soldiers.
