Subject – INJUSTICE IN FIXING PENSION OF HONORARY COMMISSIONED OFFICERS BY 6th PAY COMMISSION PRE-2006
Sir,
Highly dedicated JCOs are granted Honorary commission at the
fag end of their service in recognition of their long meritorious services in the different field of their works. The rank attracts mainly financial benefit, but the same has been denied to them by the 6th pay commission. They have to discharge the duties equivalent to regular officer. But step motherly treatment has been meted out to them by the 6th pay commission while fixing their pay.
Honorary Commissioned officers have been brought in pay band three with pay scale of 15600-39000. In This connection it is submitted that:-
(a) Bringing the Honorary commissioned officers in PB-3 is
not correct as it is against the spirit for grant of Honorary Commission. Honorary Commissioned officers can not be equated with regular officers since these are two different streams and have different terms and conditioned of services. This has been justified in a Judgement pronounced by the Principal bench of Armed forces Tribunal wide TA No 313 of 2010.
(b) Prior to implementation of Govt. orders of 6th pay
commission JCOs of the rank of Honorary Lt. and Honorary Capt. were getting fixed salary of Rs. 10500 and Rs 10850. respectively and their pension was being determined at 50% of their fixed salary as determined by 5th pay commission.
(c) The 6th pay commission has not given any consideration to
the conditions under which JCOs are granted Honorary Commission after long and unblemished service. They have been brought in the pay band three instead of giving them fixed salary.
(d) Honorary Capt. and Honorary Lt. are the Highest ranks in the army in the PBOR stream as is the case of general officers
cader in the regular officer stream.
(e)COAS,VCOAS and army Commanders were also given
fixed salary in the 5th pay commission and in the 6th pay commission also they have been given fixed salary with a considerable hike.
(f) The JCOs granted Honorary commission have been ignored
and discriminated by the 6th pay commission lowering their pay and pension drastically.
Taking into consideration the service conditions and decisions of previous pay commissions and also the recommendations of 6th pay commission and applying fitment formula of 1.86 recommended by 6th pay commission and approved by the Govt. the pension of Honorary Commissioned officers works out given below.

Due to the Anamolies and flaws at the behest of the 6th pay
commission Honorary rank of Lt. and Capt. are getting lesser amount of pension Rs. 1965.00 and 2291.00 plus DA respectively per month. Ministry of defence is humbly requested to look into the matter and rectify the Anamoly in the fixtation of pension of Honorary Lt. and Honorary Capt. to the tune of Rs. 15465.00 and 16141.00 for all pre.2006 Honorary Commissioned officers.

The case of officers of the rank of Major and equivalents from two other services is with MOD, having been favorably adjudged by AFT,and MOD's clearance is awaited as of now,if I am not wrong.
The aspect of misinterpretation of 6cpc recommendations(Head 'Modified Parity') at the bureaucrat level of MOD is now an Open Secret and I presume that on the same grounds a favorable decision in respect of Hony Lts and Hony Capts may be expected.The awfully bad attitude of the bureaucrats is,however a matter of grave concern for the veterans of all the three services and as the matter is already in the knowledge of the Govt.,it is very much desirable that delay in deciding the issue be minimised.
Effort of Sub Maj(Hony Capt)Sarjit Singh and members of the Honorary Commissioned Officers'Association is appreciated. Let us hope for the best !
The petition of Sub Maj(Hony Capt) SARJIT SINGH is self explanatory and is appreciated.The sense behind details furnished in sub para (a) of the petition is, however, not understood.Has the AFT categorically isolated Hony.Lt and Hony.Capt ranks while releasing their verdict in favor of Majors and equivalent? Request clarify.

SIR KINDLY NOTE THAT PCDA CIRCULAR 430 DATED 10 MAR 10 TABLE 133 PAGE 155 HAS ALREADY MENTIONED THESE PENSION SCALES FOR HONORARY VICEROYS LT/CAPTAIN .THEY WERE ALSO HON OFFICERS IF THEY CAN BE GIVEN ENHANCED PENSION THEN WHY NOT DTHER HON.OFFICERS.A WELL WRITTEN LETTER WHICH NEEDS TO BE TKAEN UP THROUGH A BIG ASSOCIATION LIKE IESL/IESM ETC.HON LIEUTENANT SUDESH KUMAR RETD.
SIR, ARMED FORCES TRIBUNAL HAS GIVEN THE VERDIC IN FAVOUR OF HONORARY OFFICERS ON 31 MAY 2011 .THE SAME MAY BE SEEN IN THE TRIBUNE NEWS OF 01 JUN 11.
The case of pension relating to viceroy commissioned officers has since been deleted from the circular issued by CDA(Pensions),Allahabad as such the verdict of AFT,Chandigarh in favor of Hony Capt and Hony Lts by linking them with the case of Viceroy Commissioned Officers will have no virtual relevance as I feel.The aspect of misinterpretation of 6cpc recommendations(Modified Parity) is very much relevant in this case too as was there while deciding the case of officers of the rank of Major and equivalents from the other services.
The attitude of the related bureaucrats is not only ridiculous,it is shameful and condemnable in its totality.They are 100% aware of their academic lapses in this regard and are still playing with the legitimate claims of the veterans - a definite case of misuse of chair(s) and should have been,by this time,monitored by someone more responsible in the Defense Ministry to bring an end to this long outstanding episode.
i am Hony Fg Offr pre-2006 Surjit Singh pettition very welcome one.i wsh to state that pension of MWO (gp X) equalent to Sub Maj is Rs 13590,wef 01 07 2009 as per table 124 of MOD letterno.PC10(1)12009.D(pen Pol) dated 08 03.2010. this info. may be useful
Is any thing happening on the issue of correcting the anamoly in the pension of Honorary ranks? If yes please do update.

Once a Hon rank JCO is given PB3 scales, he should not be called Hon. legal dictionary meaning of Honorary is holding title without performing services or receiving a reward. either call them Hon. and do not pay them or pay them and do not call them Hon.
Most likely govt will include Honarary ranks revised pension in letter,which is expected to come out anytime this month.
This is regarding status of Honorary Commissioned Officers
when they go to CSD Canteens. Although they have a officers smart canteen card, they have to stand on general que for purchase of items. Officers are provided with separate counter where as Hony Officers are not permitted to
by items from that counter. They must be given separate counter or priority be given on general que
Hon officers are given a step mothely treatment in Canteens and ECHS. Can this be taken up through AFT?
