WILL JUSTICE BE METED OUT TO PBORS ?


Justice delayed amounts to denial. The 6th CPC had done a great injustice to thousands and thousands of pre 96 Sepoys, Naiks and Havildars and the equivalent ranks of Navy and the Air Force.


It is a pity that these men are so innocent that they don’t even understand their right for a full pension. They have no God father. There is no unity among them. Their level of education is also very low. The thinking capacity of a retired soldier and his family is made to erode by giving liquor to them even after retirement.


Who the hell is asking for liquor to a retired soldier ? What is the motive behind the issue of liquor to the retired soldiers and to their widows, while they are struggling for their survival without proper pension and re-employment opportunities?


The motive behind issue of liquor to the poor retired soldier and their widows is to make them not to demand any thing to the Government, and to make them live in a drunken state throughout their life and die like a dog by slow poisoning them. This is true. Most of the pre86 and pre96 soldiers (PBORs) are people living below poverty line and non-matriculates, school drop outs, living in remote villages. They all joined the defence forces due to poverty and unemployment. This category of men definitely did not join the services to protect the mother land. It is because of extreme poverty, they joined the services. Later during the stay in the service, they are made to sacrifice every thing as there was no other go for them.


The Government is capitalizing this poverty for their benefit and exploiting them in an unscrupulous manner. Everyone knows that a soldier cannot remain as soldier for 33 years. It is to keep the youthful profile of the armed forces very young and fighting fit, these soldiers are given good bye at the age of 38. They are not allowed to serve for 33 years and shunted out compulsorily without any guarantee for re-employment. But when the question of pension calculation is involved, these 33 years is brought in and the pension is drastically reduced.


The main grievance is that when the authorities very well know that these men are not going to serve for 33 years, then why at all this yardstick of 33 years is imposed for calculating their pension. There should be some reasonable compensation in their pension when they are forced to quite the service. The Government should magnanimously decide the amount needed for a peaceful retired life when it cannot guarantee re-employment. Instead of giving better pension, better re-employment chances, giving them cheap rate liquor to these poor soldiers is nothing but cheating the entire disciplined soldiers. Thousands and thousands of crores are being spent on defence, yet the rtired soldiers are running pillar to post for a reasonable pension for their livelihood.


The 6th CPC recommended Rs.3700 to a retired soldier, where as the same commission had recommended Rs.45000/- monthly pension to some one else. The ratio of minimum to maximum is not even 1:10. There is no justification. Is it not an injustice ?


It is only the poor people who live below poverty line, who cannot afford higher education to their children, are sending their children to defence forces in the PBOR cadre. Nowadays, the educated youth does not prefer to join defence services even in Officer cadre.


The defence forces are remembered only in total war, and in great national calamity. When a nation faces war, the enemy is identified and driven away. When a war is on terrorism, the enemy is not easily identified. There cannot be time bound action on terrorism. There is a continuous threat all over the country. The home minister recommended additional police forces to contain terrorism. The present political and bureaucratic setup and system cannot find a solution for containing terrorism. In the circumstances neglecting the past soldiers is not good for the country. If the situation continues, the govt. may have to enforce compulsory military service to safe guard the nation.


A strong defence forces are a must. A country cannot survive without a defence force. If this is understood clearly, then all steps must be taken to keep the past and the present men in the forces happy. The quantum of minimum pension given to soldiers is to be decided based on his past service and sacrifices made by the soldiers and not by comparing with civilian employees. The pension given to a soldier is to be treated like a compensation for his sacrifice to the nation which must help him a peaceful life free from want.

2. I understand your conern for the depressed Jawans and the Jcos.It is high time that the long standing issues of the PBORs are resolved in a graduated manner.

The secretaries Report is going to be a big disappointment to PBORs since it has belied the expected revision of pension to 70% from the present 50 % of the Maximum of the pay scale prior to 01 Jan 2006.
The recommendation with regard to revision of pre 2006 PBORs pensioners reads:
"To reckon the pension of all pre 1-1-2006 PBORs pensioners with reference to Notional Maximum of the Post 2006 revised pay structure corresponding to the Maximum of the pre 2006 pay structure as per the fitment table of each rank"
Also to continue with the enhanced weightage awarded by the GOM.
What does this imply ?
The revised pension for ALL pre 2006 PBORs pensioners would be 50% of the maximum of Notional Pay scale as given below which is copied from the table given in the 6th pay commission report:
Sepoy 50% of Notional maximum of13500= 6750
Naik 50%of 14460=7230
Havildar 50% of 16040=8020
Nb Subedar 50% of 22030 =11015
Subedar 50% of 25040 =12520
Sub Major 50% of 25340 =12670
This calculation is based upon my interpretation only .Hence any errors or omissions are excepted.(E&OE)
The above pension is for the qualifying service of 33 years including the weightage authorised.
The final figures would be available on final Govt notification which are likely to be close to the estimated calclation as given above.
This should please some while some would feel disappointed.

I wish to correct my estimate of the amount calculated. My calculation was based on the table that 6th pay commission had recommended.However it was subsequently amended by the Secretary committee that had reviewed the recommendation by the commission. Accordingly the revised pension would be 50% of 1.86 times the max of 5th pay commission pay scale corresponding to each rank + Grade pay +MSP +Group pay.
This should make some pensioners happier.

The revised pension per the proposal of secretary would most likely be for X group with 33 years of service including weightage:

Sepoy 50% of 14050 = 7025
Naik 50 % of 15060 =7530
Havildar 50 % of 16710 =8355
Naib Subedar 50 % of 23020 =11510
Subedar 50 % of 26210 = 13105
Sub Major 50 % of 26900 = 13450

You may verify these figures from the table in 6th pay commision report , modified by the secretaries Report.The formula for my calculation was given in my earlier comments.
