GOOD NEWS FOR HON. NAIB SUBEDARS.

Hon. Naib subedars, a rank conferred after retirement was given pension benefit of Rs.226  p.m. (6^th CPC pre 01.01.2006) over and above Havildar pension.  Accordingly tables were prepared along with CDA circular No.430 dt.10.03.2010 (Tables 26 to 30) and pension disbursed.

Earlier on 12^th June, 2009 the MOD issued a letter (Click here for the letter) authorizing regular Naib Subedar pension to Hon. Naib subedars w.e.f. 01.01.2006.  However, the letter did not mention anything  about the applicability of any cut off dates to the beneficiaries.

But the MOD interpreted negatively and allowed only to post 01.01.2006 retirees.  Some aggrieved Hon. Naib subedars approached the Hon’ble AFT Chandigarh and the AFT Chandigarh in Feb 2010 ruled that the benefit shall be available to all the Hon. Naib subedars irrespective of date of retirement.

The MOD challenged the said orders in the Hon’ble  Supreme court by way of SLP.  Now the SLP was dismissed last week  thereby upholding the orders of the AFT Chandigarh.

After the new orders, the pension of pre 01.01.2006 Hon. Naib Subedars will be revised as that of Regular Naib Subedars.

Now can any one Ex-servicemen Association come out with the revised pension tables for the pre 01.01.2006 Hon. Naib Subedars  before the MOD prepares ?
