DELINKING OF 33 YEARS FOR FULL PENSION FOR EX-SERVICEMEN
RE-EMPLOYED AND RETIRED FROM BANKS INCLUDING STATE BANK OF INDIA
The pension regulations of all the nationalized banks was
framed in 1995. The basic concept was
adapted from Central Civil pension rules.
Therefore the 33 years service for full pension in banks also was
adapted from the central civil pension rules.
Now that the requirement of 33 years service for full
pension has been removed by a supreme court judgment and the depoartment of
pension and pensioners welfare had issued orders for delinking the 33 yrs. for full
pension.
Since the basic pension regulations of the central pension
rules has been amended by the Supreme Court judgment, the same amendment is to
be done in bank employees pension regulations 1995 also without any legal
intervention. The same is applicable for
State Bank of India pension regulations also.
It is the responsibility of the bank management to amend the
rules suitably and remove the 33 years conditions for full pension and allow
full pension to all irrespective of number of years of service.
State Bank of India, although they claim to follow separate
pension regulations, is also having the 33 years condition for full
pension. Therefore the SBI management
also should review their pension regulations to meet the judgment of the supreme
court.
This land mark judgment was obtained by an individual’s

Now the majr trades unions of the banks and various pensioners
associations and ex-servicemen welfare associations should take up the case with
the bank management immediately for payment of full pension.
Who will tie the bell to the cat? Will the unions take up the issue?.It is the responsibility of department of banking affairs functioning Under the finance Ministry should issue orders to INDIAN BANKS ASSOCIATION in line with Om issued to advise the banks suitably. Mostly ninty nine percent under pro rata pension in banks are like us ESMs and compassionate ground employees only. If collectively taken up the matter under the umbrella of an organisation under cost sharing basis if need be. Otherwise the beneficiaries will have to remain unattended. ReplyDeleteTHE LANDMARK JUDGEMENT OF JUDICIARY IN THE CASE OF DELINKING OF 33 YEARS OF SERVICE SHOULD BE EQUALLY APPLIED TO PUBLIC SECTOR UNDERTAKING AS WELL SINCE THEIR PENSION REGULATIONS ARE BROADLY BORROWED FROM CENTRAL PENSION RULES. LET US SEE HOW MANAGEMENTS OF PSUs SUCH AS STATE BANK OF INDIA, STEEL AUTHORITY OF INDIA ETC REACT TO THE JUDGEMENT AND QUICKLY MAKE SUITABLE AMENDMENTS TO THEIR PENSION RULES. IF THEY ACT PRUDENTLY, THEY COULD AVOID JUDICIARY INTERVENTION. OTHERWISE, THEY SEE SIMILAR JUDICIAL LITIGATIONS AND WILL GET THRASHED BY HONOURABLE COURTS TO IMPLEMENT THE SAME. HENCE, IT IS IN THEIR BEST INTEREST TO MAKE THE CHANGES BEFORE THEY GET UNDESERVED THRASHING BY HONOURABLE COURTS.

ReplyDeleteit is realy sad to note one side the Govt keep on promising something and do nothing.Eg Retired re-employed ex-servicemen pension has to be paid 50% of pension if they put up more than 10 years.This order has been signed by the Minisrty of finance in april6 2016.In this circular pension regulation has to be amended by the banks.Whereas till date nothing is being done by the banking authority. No body bothers about revision of pension.Pensioners are going to post and pillar for wantof revised pension.God only can save the ex-servicemen
ReplyDeleteit is sad to note one department issue orders for revision of pension of those retired ex-servicemen reemployed in nationalised /state bank of indiaThe orders were issued on6th april2016 till date no organisation has revised the pension of ex-servicemen re-employed in Banks .We are yet to know who is authority who can help
