THE JUDGMENTS OF ARMED FORCES TRIBUNALS

There is growing concern among the Defence Personnel that, most of the judgments given in favour of the Defence Personnel are not implemented by the Ministry of Defence.  Instead the Ministry of Defence has been filing appeals against these judgments.

Over 90 percent of the 4000 cases filed by the Defence Personnel in the AFTs, were decided in favour of them.  If all these cases are referred to Supreme Court, then the very purpose of establishing an AFT is defeated.  Even the judgments given in favour of Defence Personnel by the Hon’ble Supreme Court have not been honoured.  The situation is alarming.

If it continues unchecked, the morale, of both the retired and the serving defence personnel will be upset to a great extent.

There is need to give due respect to the Judgments given by the Armed Forces Tribunals and other Higher Judiciary. People have great faith on our Justice system.  That must be safeguarded at all times and at all costs.
