ENHANCED RATE OF FAMILY PENSION

THE PURPOSE OF ENHANCED RATE OF FAMILY PENSION IS TO BE PROTECTED.

After the implementation of the PCDA Circular No.430 dt.10.03.2010 (Improvement in the pension to bridge the gap in pension of pre 01.01.2006 and Post 01.01.2006 discharged personnel below officer rank (PBOR) of Armed Forces) the pension of the PBOR has been revised with effect from 01.07.2009.

An anomaly has been created by this Circular by not making it applicable to the family pensioners of PBOR.  Also basic pension regulations has been ignored in this case, because after implementing these orders, whatever changes to be made in the normal rate of family pension (Which is always linked to the pension payable to the pensioner) which is 30% of reckon-able emoluments and in the enhanced rate of family pension which is @ 50% of reckon-able emolument + DA or at the rate not exceeding the service pension authorized to the deceased after the death is neither made nor allowed the PDA to make.

The PDAs are facing utter confusion in arriving at the amount of enhanced rate of family pension payable to the eligible widows of the PBORs who died after the implementation of the circular No.430.  The enhanced pension mentioned in the PPOs does not reflect the actual revised enhanced rate to be paid as per the basic pension regulations.

An illustration:  In the original PPO the enhanced rate is mentioned as say Rs.2828, the same was revised as Rs.4277 as per MOD letter dt.11.11.2008 and Rs.5492 as per circular No.430.  The pensioner was getting a revised pension as per circular No.430 Rs.5492 at the time of his death.  As per the existing pension regulations, the widow should get the same Rs.5492 as Enhanced rate, where as the Banks are paying only Rs.2838.

The existing pension regulations say that the enhanced rate of family pension is applicable @ 50% of reckonable emoluments + admissible D.R applicable from time to time or at the rate not exceeding the service pension authorized to the deceased after the death.  The PDAs may be allowed to follow this rule.

The MOD and the PCDA(P) may issue suitable instructions to the PDAs and guide them accordingly.  The widows of the PBORs, whose husbands died after the implementation of the circular 430 are denied legitimate enhanced rate of family pension.

It is requested that the Indian Ex-services League, the Air Force Association and all other recognized Associations may take up the matter with MOD and bring them justice.

IGNORING A BENEFIT TO THE  POOR INTENTIONALLY WILL AMOUNT TO GROSS INJUSTICE.
