OROP ARREARS PAYABLE TO A DECEASED PENSIONER

Arrears of OROP was paid to all Defence Pensioners as per CDA Cir.555 dated 4.2.2016 in four Instalments starting from March, 2016.

The First Instalment was paid in March, 2016 and the Second Instalment was paid September, 2016.  Some pensioners have died  after receiving first instalment and some pensioners have paid after receiving second instalment and some have died without receiving any instalment.

In the circumstances, it is the duty of the Family pensioners and the Legal Heirs to verify the pass book and make a claim to the Bank by attaching a Death certificate and OROP Arrear calculation sheet.

If you are not alert, you will not get.  The OROP arrears are slated to be paid in instalments on the following dates. 

1.      First Instalment  in March, 2016.
2.      Second Instalment in September, 2016.
3.      3rd Instalment in March 2017.
4.      Fourth Instalment in September, 2017.

DELINKING ARREARS TO RECRUITS AND FAMILY PENSIONERS

All invalided out pensioners including recruits are eligible for the Delinking arrears.  Clarification has been given by CDA(P) Allahabad in this regard.  The CDA clarification letter is published in our website www.exweltrust.in

All family pensioners whose husbands died after 1.1.2006 are also eligible for the Delinking Arrears.  All Family pensioners of this category are to apply immediately with a copy of PPO, death certificate, Bank pass book copy and a Delinking Calculation sheet.

The Delinking arrears is payable for the period from 1.1.2006 to 30.6.2014.  Therefore the pensioner who were alive during the period from 1.1.2006 to 30.6.2014 and died after 30.6.2014 will be paid the arrears to their wives as LTA.

Every circular clearly instructs the Banks to pay the arrears to the family pensioners.  But the banks are not paying.  Most of the family pensioners are not aware of their entitlements.  A pensioner discharged prior to 1.1.2006 and died any date after 1.1.2006 their families are eligible for the delinking arrears till the date of death.

Suppose if a pensioner of the Rank of NK with a service of 15 years Y group died on 1.1.2010, his wife will be eligible for a delinking arrear of R.           Now the family pensioner has to submit the claim with the following documents to the bank.

            1. Copy of PPO/Pension book.
            2. Copy of Death Certificate of the pensioner.
            3. Pension documents showing the Rank, Service and Group of the pensioner.
            4. Copy of front page of the Bank pass book.
            5. Copy of Delinking arrear calculation sheet.
            6. An application requesting to pay the delinking arrears.

Send all the documents by Registered Post to the CPPC of your Bank.  If the bank is not paying within one month, prefer an RTI application requesting to provide the position of the application.

Recruits and others having service less than 15 years service can submit this letter
to the bank and claim Delinking arrears.

INCOME TAX DEDUCTION ON DEFENCE PENSION

The Financial year 2016-17 had created an unprecedented increase in the pension because of the payment of Delinking Arrears. OROP 2nd Instalment and 7th CPC arrears.  This arrear payment had caused Tax Deduction from December, 2016 even to a low paid pensioner. This tax deduction will continue till March, 2016. You have to file IT Return and get refund.

Many banks have made TDS at 10% and 20% irrespective of the age of the pensioner and PAN number registration with the Bank.  An 80 years old pensioner (A Sepoy) will not be subjected to any TDS even with all the arrear payment.  But the some banks have deducted tax to these aged pensioners.  Many of these old pensioners do not have PAN Cards and it is very difficult for them to get refund of the Tax Deducted.  Instead if the Banks have made proper calculation of Tax for these old pensioners, this could have been avoided.

These pensioners come into the tax bracket only for the assessment year 2017-18 because of the arrear payment.  Now in order to get refund (Tax relief) they have to apply for PAN Number, file Form 10E online and approach an Auditor for claiming refund.

A 55 years old Low paid Sepoy Pensioner have been charged Rs.10,234 as Tax for the Assessment year 2017-18.  (The Tax Rebate of Rs.5000 under Section 87 is not taken for TDS)
Same way a 81 years old low paid Sepoy Pensioner have been charged Rs.11848.  If the age of the pensioner was taken into account while computing TDS no Tax would have come for him.

Now that everything has been done.  Now the only remedy to get refund of the Tax deducted  is to go to an Auditor and file Tax return immediately.  Otherwise, you will not get the refund.
All pensioners have to submit PAN Number to the Bank immediately.  Those who want to claim refund have to file Form 10E online.

It is better that all the Defence Pensioners file Income Tax Return  every year.
